Good time of the day guys,
I address you for advice in a very tough situation. I've been together with my common law partner for 2,5 years, we submitted the application for my permanent residency, everything was great until the day when I found out he has been seeing another woman behind my back. It was a great shock for me,from his side it wasn't just a temporary affair but a serious crush and I had to leave him. Now I don't know what to do,my immigration lawyer is advising me to pull the application because the risk that CIC will find out I'm not cohabitating with my sponsor anymore. I would appreciate any advice on this case. I'm Thank you everyone
 
The lawyer is right... this is called fraud if you continue with the application and are NOT together as stated. Better to withdraw the application and go back or stay in your home country depending kn your situation and try and enter canada if you wish using another stream of entry

Thank you for your advice. I have my OWP until 2019 which cannot be revoked even if I withdraw the application is that right? I'm really devastated by what my ex partner has done to me,the fact that my relationship ended was never my fault.. Is there a chance to apply for so called compassionate ground PR?

You are not likely to be approved on compassionate grounds, but the good news is that your work permit will continue to be valid until its expiry.

Yes - your OWP is good until it expires.

You can try applying for PR under H&C. However approval rates are very low and there are exceptional circumstances needed to succeed. Unless there's far more to your history than a relationship not working out - H&C is pretty much guaranteed to be refused.

You would be far better off qualifying and applying through one of Canada's economic immigration programs like Express Entry (either FSW or Canadian Experience Class). You have an OWP for another two or so years. Put that to good use and get at least 1 year of full time work experience in a NOC A, B or 0 role.

He became rude,neglecting and disrespectful,so I had serious talk with him and this is when he admitted he has an affair. He was much older then me and I never expected him to trade me for someone else, we had pretty good and solid relationship (at least I thought so). Basically he let me know in a non-verbal way: "Get out"..

Humanitarian & Compassionate. What you've described doesn't fit H&C unfortunately - it's simply a relationship gone wrong (which unfortunately happens from time to time). You want to avoid applying for H&C unless the chances of approval are high. Once you have an H&C refusal, it will become infinitely more difficult to obtain any sort of work permit extension or future work permit or future visitor visa to Canada.

Again, you should focus on economic immigration programs like Express Entry. This is your best bet for being able to stay in Canada.

Make sure your hospitality job falls into a NOC A, B or 0 occupation. Some hospitality jobs do and some don't. You will have a much higher chance of having a future in Canada if you are in a skilled occupation.

H&C apps are for cases where your life would be in real danger if you returned to your home country, or if you would be leaving behind a child if you were to leave Canada. This really doesn't apply to your situation at all, so you should not even consider a H&C app as it would be a practically zero chance of success.

You must cancel the PR app right away. Typically the sponsor is the one that initiates this, since they are the one that would be liable for you financially for 3 years after you become PR.

As I understand it, your OWP would remain valid to its expiry date even after the inland PR app is cancelled.
