Well I am looking at various applicants (post june) and it shows that they receive Medical as soon as their status changed into "in process". In one case from buffalo, status was changed into "in process" on 25th April, and Medical sent on "28th April". So once "in process" all the documents, and initial background checks are completed. According to Client Application Status explained by CIC,

Visa Office - Eligibility Review Complete
The review of the application and supporting documents has been completed at the visa office. A letter with additional information has been mailed.
In Process
Based on review of your complete application package, it has been determined that your application is eligible for processing.
Processing has begun.

So my guess is, 4-5 months that Visa Office takes to change status into "in process" is used for background document check.

Processing has begun means, review and screening has been completed. They are processing according to Medical-security-PPR.

So IMO you cannot be rejected through reasons such as NOC duties not matching, insufficient points etc, once your file has gone "In Process".

However, during processing your application will undergo firstly document background checks on educational documents, work experience documents (which may involve them contacting your employer), proof of funding etc.

Secondly, after medical requests are issued, the application will undergo security checks.

So once you are "In Process" the application can still fail if the visa officer is not satisfied with any of the document background checks, or if you are criminally or medically inadmissable to Canada as a result of the medicals or security checks.

When it comes to points? Have I achieved enough points at this stage? Had they calculated points already at that point?

I sent a query two weeks ago about the e-cas inconsistency that it could be interpreted as DM, and they replied within an hour... No decision has been made yet as there has been changes in the e-cas program.

It´s a fact that no one can considered to be safe until having your PRV on your hand, BUT with that info I have just provided, how can you all interpreted my case status? NO MR yet.

Hmm , much good discussion points but still I don't get exact perfect answer , still some people says possible rejection dueto lack points (if your points not enough) becasue in-process review pending is the stage CHC VO recalculate the points at this stage.

But some people in same situation I seen in this forum that they applied in after Feb 2010 they recently got 2nd AOR and same status.
so what is the exact process lots of people dont know still (I guess) , I generate CAIPS yesterday I applied for CAIPS, waiting for result uhh it will take 6weeks atleast.

Hi!

I think you have lost your 2nd AOR in post. Didn't you ask in your query where is your 2nd AOR or new file no? From the situation you telling now your case seems to be in process and yes you scored the enough points thats why your case went into process. It looks everything going ok for you... :)

@canadahome: As far as I think in my opinion, as per new rules the application is filed with all the supporting docs direct to Nova Scotia. Ofcoarse if the application does not match the required points, or any doc is missing they will reject it and they will not send the AOR. They will not forward it to the VO because of lack of points or docs and the application will be sent back to u. I am not much experienced but this is my point of view as I am a new applicant and member of this forum.

Dear your case seems different from others as I have not seen somebody receiving 3 file numbers. I think its your visa office which is different from others. I do pray for you, you receive your MR soon.....

Even I seen some OP's here and on another forum that they have same doubt but not clear, even I also don't much more understand this In-process + Pending review, CIO already review our case and CHC issued 2nd AOR then why again the case going Pending review and why the CHC issue 2nd AOR without complete the review.
lots of steps are not completely understandable from CHC part but we can assume that 2nd AOR and case in-process means Eligibility review completed and pending review of applicant background checks. As per my understanding what I know this steps.

Today I got 2nd File number from Buffalo NY USA.
My E-case is "In-process" as my lawyer said my all documents and eligibility completed.

Yes, Canada accepts Skilled Workers based upon their ability to become economically established in Canada. If the Canadian Immigration Visa Officer believes that the point total does not accurately reflect your ability to become economically established in Canada, the Canadian Immigration Visa Officer may use his or her positive discretion (referred to as substituted evaluation) and approve your application even though you score less than 67 points.

However, at a minimum, you must have worked continuously for a period of at least one year, within the last ten years, in a full-time (or part-time equivalent) paid position at a skill level recognized by Citizenship and Immigration Canada.

Additionally, you must meet CIC requirements to have either one continuous paid full-time year of work experience in the 29 qualifying occupations in the past 10 years; OR Arranged Employment.

This is called subsitutue evaluation. which can go both ways..positive or negative.

Negative subsitutue evaluation: Applicant meets 67 points criteria but VO thinks applicant wont be able to succeed in Canada based on XYZ reasons and this has to be approved by program manager.

Postive subsitute evlauation: applicant does'nt meet 67 points criteria but has requested for subsitute evaluation based on xyz factors and supporting docs...VO thinks he can be succesful and needs subsequent approval from program manager.
