Hi folks,

I've got a Filipina girlfriend/lover/best friend that I've met in January 2015. We wanted to be able to spend a bit of time together but knowing that TRV's are usually denied when there's a romantic connection we had my friends invite her.

We're hoping to get married in the Philippines and be together here in Canada. Unfortunately, she's had a previous marriage, (to an American, that didn't last long at all). So we're going through the annulment process, taking a long time, 2 + years so far.
So in the meantime we just wanted to be able to spend a bit more time together than the little bits of time I'm able to travel there to see her. So we did the 'fake' invitation.

Now I've been told that even once we marry, after achieving the annulment, that the VO would dig up this 'invitation' and we could be denied even full spousal sponsorship!

Oh, bye the way, I've since visited her 3 more times since 2015. Three January's in a row plus a trip in the summer of 2016. I'm about to travel there again this February 2018 for a month. We've never missed a day of texting and doing video cam calls on Facebook messenger.

I was hoping to try for another TRV and telling the CIC VO of our blunder and that we just wanted to see each other and show that we are serious and upstanding community members each in our own countries.

Or wait out the annulment and get married and hope with all our hearts that we would be forgiven for our mistake and allowed to be together through the spousal support process.

Has anyone had, or heard of any situations like this?

Never make it a practice to lie to CIC. However I don't see this as a deal breaker. Did she get the visa? The invitation is not the most important part of her application. Her ties and certainty of returning to her home country are the most important. Please do everything above board from now on.
 
So to clarify the "fake" part of TRV app was that her friends in Canada invited her and you were not mentioned anywhere?

Considering she was single and you were just dating with no legal relationship at the time, not sure how serious this would be. An explanation may suffice.

Yes, I will make sure everything is above board from here on in. It seemed innocent enough to us at the time, though now I can see how the CIC VO would see it completely different. She didn't get the TRV. There was FIVE reasons she was refused. Though they did call her in for an interview!?

It would be great if she could visit while we wait for this dang annulment and then marry, and then go through the Spousal Support process. I did do a phone consultation with an immigration consultant and he advised me to not try any visa entries for a duration of time, at least a year or so :(

I wondered if he was being overly cautious.

You can always consider a conjugal app. There are many successful conjugal apps similar to your case with Philippine applicant's previously married. IRCC does not make in mandatory that you must wait for an annulment to happen to re-marry.

I have looked into the conjugal app. Though the immigration consultant I paid $200/hour for, just prior to this last Christmas, told me to not try that as it would look like she's using any means possible to get out of Phil / or, alternatively, enter Canada. Even though we should have no problem proving a genuine relationship for the last 3 + years.

By far the vast majority of successful conjugal apps, are those in your exact situation where Philippine applicant is previously married, divorce is illegal, cohabiting with a married person is illegal, and they have been refused a TRV to Canada. This is the text book definition of what a conjugal app was designed for.

With a solid proof of a 3 year conjugal relationship, you would have a great chance for a successful conjugal app. I completely disagree with your consultant's advice.

Your consultant is not correct on several issues. Conjugal could work for you with such a long history in your relationship. You can reapply for a trv at any time but you should not unless you can solve the 5 reasons for refusal. It is almost hopeless so I would put my energy into the application for sponsorship. If you read this forum over and over you will find all you need. good luck.
