Hi

We want to enter canada with less than a year left for PR expiry which will expire in July 2015. I have the following important queries which I request the experts to help me with.

1) My wife's PR card is on her maiden name. After marraige she got her surnamed changed in her new Indian passport. Will there be a problem at the canadian immigration because the surname on her PR and passport don't match?

2) If we are let in Canada and we live there with expired PR (after July 2015) but if there is an emergency back home (death, serious illness of loved ones) and I want to leave Canada but my wife and child stays back in Canada.
Can I re-enter Canada with expired PR on the grounds that my family is living in Canada and that I had to leave Canada on an emergency?

3) Will there be any problem in getting health insurance for Alberta? We applied for SIN cards when we first went to Canada in 2010 but did not apply for health insurance or driving licence.

Appreciate your guidance on the above.

1. There may be issues at Canadian airport if CBSA ends up checking if you've maintained PR status (2 yrs from 5 yr period).
You won't even qualify for renewal if you don't meet residency requirements. So you gotta sort your mess first. Carry all documentation which shows you had compelling reasons to not reside in Canada (study/job in India is not a valid reason).

2. You can't board a flight with an expired Pr Card back to Canada. If card is expired, you will need to get a PR travel document from CHC NewDelhi.
Not sure if they will issue a PR TD without checking your residency obligations, again it's a can of worms you will open by applying for a TD.

3. PR Card and passport should (technically) show SAME names. Not sure about airline/India rules. hope some indian members can help u in that.

4. Alberta offers health insurance from day 1, it should not be an issue, provided there are no other issues.

Even if you manage to get into Canada without being examined in detail by CBSA, you must live at least 2 years before qualifying for renewal of
PR Status/Cards. CIC may seek evidence of residency ties you got in Canada (lots of paperwork).

1. As long as she has her marriage certificate showing the name change, that won't be an issue.

2. Don't leave. You wouldn't be able to board a plane with your expired card. Unless you have serious H&C grounds for not meeting the RO, applying for a PRTD would most likely result in the loss of your PR status. Crossing overland from the US could result in you being reported at the border, also leading to the loss of your PR status. It won't matter that your family is in Canada.

3. With valid PR cards, there would be no issue getting healthcare.
