Hi all

I have been looking everywhere trying to find information on what to expect at customs when someone voluntarily goes home.

My husband and I have been married for 2 years, however his work visa expired Dec 15 2014. And has been living here in Canada with me "illegally" while our family sponsorship application has been in progress. I have been approved and all the medicals done and now he has been called for an interview in Jamaica. His passport is good (renewed here at the Jamaican Embassy), however we can no longer locate his work permit.

We fully understand that his voluntary return will not grant him access back into Canada until our application is complete and immigration grants his re-access.

What we are thinking about now is what are we to expect when we go to fly home to JA. Is there a chance that he could be detained for overstaying his work visa for so long? Or any other repercussion?

Thanks, any information would be greatly appreciated!!

There's no chance he will be detained. Provided he has a valid passport, leaving will be easy. Canada has no physical exit controls.

Just to add - interviews are typically only called when CIC has some kind of concerns about the application (typically because they want to verify the relationship is genuine). He should not assume the interview will be a cake-walk. I would bring additional evidence to demonstrate your relationship is real and ongoing.

Thanks scylla

That is a relief that there should be no concerns at customs.
Yes we are prepared to overload them at the interview with evidence to show just how real our relationship is!
