I married my husband (American Citizen) in October 2015. He had been visiting me as much as the rules allowed for 2.5 years. He had a work visa application in process in August 2013 but the company withdrew it when the process changed. The company had had previous immigration issues and it was audited. He does not have work in the U.S. I got a second job to raise the funds required for spousal sponsorship . When we crossed to Canada Nov 1st the border was concerned about the amount of time he is spending here. He was given a Visitor Record till January 3 Rd to give us time to do his medical and so we could have Christmas together . I have a 10 year old who is extremely attached to him.
During his medical we discovered he was a diabetic. We found him a family Dr and started treatment ( this was required to satisfy the immigration Dr) . I pay for all his Appts and treatment so it took longer to raise the fees. We immediately applied for an extension to the visitor visa. The Dr had also wrote is a letter saying he needed regular follow up which he wouldn't get in the States.
On December 28 th we went to a port of entry to ask questions because we had no response yet to our application. They said the application gave implied status until we heard otherwise so we went home. Happy to have a little reprieve. Two weeks ago we got the extension but it is only till June 30th. And it does not allow re entry. My husband is not responding to the first course of treatment and the Dr has had to increase And change meds. He really needs to be followed regularily.
Our application was submitted and awknowledged late March. By what I read online if we apply for another extension it will likely be denied now that he has an application in process. Each visitor extension application is $100. We really need this but if it is just going to be denied I don't want to spend the money. We applied Outland . Because the timeline is shorter but really we need him here.
If you have got this far thank you for reading and I appreciate your responses . Can't afford a lawyer .
