Hope all is going well with you

I applied for a Visitor Visa to go see my wife in Ottawa as we are expecting a baby by the end of October and I wanted to be there but my Visit Visa got rejected because I forgot to mention something on the application, it slipped my mind.

Reason of rejection:
1)You have not satisfied me that you would leave Canada at the end of your stay as a temporary resident.
x - any history of contravening the conditions of admission on a Previous stay in Canada

2)I am not satisfied that you have answered all the questions truthfully as required by section 16(1) of the Act. I am not satisfied that the following information is truthful:
You have not declared your previous visa refusal in Detroit of 2013.

I was a student in Canada and got married to my wife over there. I applied for extension of my trv and study permit but CIC gave me an interview in Detroit. That meant I had to get a US Visa to get there (The email will be posted at the End so I do not waste your time if you do not want to read it and note CIC spelt BANK Wrong they wrote BNAK - Very Sketchy Email) so I went to apply for a US Visa and they gave an Interview a day before my interview with CIC so I emailed them to make it before and they did. Did my interview and the guy said it might take a week to a year to get it. Never got a reply for the visa. Then I wanted to call the Detroit embassy and guess what they closed them down in January 29th and my interview was on the 31st so there was zero connection to them and the email they sent me had a do not reply on it. Showed all this to my school and a lawyer and he noticed that Bank was spelt wrong on the paper so he disregarded it and the school said that is really weird we've never seen that.

I ended up leaving and my wife too as I got a job in Dubai and then she got pregnant and we decided that we should have the baby in Canada. Now I wanna get back there for 3 months so I can see my baby and my wife and our dog.

Is there a chance that if I re-apply and explain my self that I will get accepted on reason number 2 ? And How do I address rejection reason number 1?

I submitted everything they asked plus extras to make my application better and a solid invitation form my wife signed and sealed by a lawyer in Ottawa.

The Email

Your application for a Temporary Resident Visa has been reviewed by a Canadian Visa Officer and it has been determined that a personal interview is required.

DATE: THURSDAY JANUARY 31, 2013

TIME: 2:30PM

Please present this email to the security desk on the main floor in order to gain access to the Immigration Section.

The following documents are required:

PROOF OF FUNDS (BNAK STATMENT AND PAYSLIPS FOR THE PAST THREE (3) MONTHS)

OFFICAL TRANSCRIPTS.

Please note that there is no guarantee that a visa will be issued.

If you do not appear for your interview your file will be closed. To re-apply, a new application and non-refundable processing fee will be required.

If you are currently in Canada, you may have to obtain a U.S. visitor visa from a U.S. Consulate in order to enter the United States. It should be carefully noted that the matter of entry to the United States for the purpose of appearing at this Consulate and any expenses incurred in this respect are the sole responsibility of the applicant. It is not possible for this office to intercede in any way with U.S. authorities on your behalf.

The problem is that Canada fears you are using your family as an anchor to immigrate illegally to Canada. In fact their fears are correct as you deliberately left your wife and kid behind "to be born Canadian" than to keep them with you.

The Visa thing is not minor but is secondary to their main concern.

What reason you have to go back to a place far from your family? In fact you are showing you can move freely around as you are asking for three months, so no real ties to anything.

So that is your task, to convince Canada you will leave and will not try to stay after your visit is over. Tough call indeed.

What/How do you think I should prceed with re-applying ?
In my initial application I stated that I have my real estate to Manage in jordan and It shows on my passporte that I fly there 1 every month and I showed proof of ownership over there. Plus in Dubai I just bevame 20% stake holder in the company I work and i mentioned that plus proof of the trade license and J stated that I would be working through e-mail alot in Canada but I needed to be back on January 5th as The year is done and alot of work need to be taken care of and this is the only time I can travel till june.

What can I do How or what more do I need to say to convince Inthought I did enough !!

No.

In fact all that would suggest even leaving for a week is tough, but you want to leave for three months... so there are things fishy in your whole situation.

Added to that is that if you are doing so well abroad why don't you get your wife with you and have the baby over there? Immigration purposes is the only reason that can come to mind and that is what Canada doesn't like.

So I do not know. My advise would be to either bring your wife over there or to get a spousal work permit (but seems you don't have much time).
