Hi everyone,

I'm PR holder and I'm having my PR card but I'm in India at the moment. I was in Canada for 3 months but then returned back to India. I got my PR when I was single. I completed my soft landing and came back to India. I got married 4 months ago and I was about to apply PR for Spouse after landing in Canada. However, I wasn't able to apply for her PR due to current situation when I was there and I had to come back to India due to medical emergency at home. I know that I will have to be in Canada before I can apply for her PR. I will be in Canada by September and I do have job in Canada. Working from India at the moment. My spouse is having her job in India. Can anyone please help me with the following queries?

1. I'm exploring possibilities if I can apply her visitor visa at the moment so that she can come early to Canada meanwhile her PR application is going on (I will apply for that once I reach Canada). Is it possible?

2. Will this application be needed to be mentioned while applying for her PR?

3. Will visitor visa application create any issue during her PR process? Also, will there be any adverse effect if visitor visa is rejected?

1. Yes, your spouse can apply for a TRV.
2. Only if it's refused. In that case you'll need to mention that your spouse has this refusal (plus any other refusals to other countries).
3. No impact.

Would not book a flight until you know that TRV is approved. Spouses of PRs and Canadian citizens have a hard time securing a TRV.

Should I mention in her PR file that I have applied for her visitor visa as I may not know about status of that file while applying for PR?

all the VAC centres are closed in India according to google.
no biometrics no processing of any kind of visa.
she will still have to satisfy the criteria for TRV success ( getting TRV is toughest).

2. The chances of being approved are not great since spouses are not temporary visitors. You should apply. Spouses who can show they have longterm good employment, have travelled internationally before to countries like US, UK, Australia, etc., have decent savings, show leave permission from job, have property, etc. have a better chance of being approved. Things may change but they don’t seem to have changed yet. Processing estimates are just estimates. If your spouse hadn’t done biometric that will be an issue given most offices are closed.
 
Hi, I am going to apply Visitor visa this week so I can visit my husband and one of the requirements that I need to provide is purpose of travel.

Now my question is, do I need to attach a Flight ticket even it is not confirm? or should I make an itinerary?My visit is just to spend time together and so we can celebrate our 1st wedding anniversary on September, not for a leisure.

Maybe I can have your opinions about this matter?

Don't buy a ticket. Just attach the details of a flight you would like to take. Unfortunately with one refusal already it is going to be tough to get approved. You should try but don't make any plans until you get an answer.

I got a refusal visa last year when we were engaged. i am nervous but Just wanna try I hope they will give us mercy so I can spend time with my husband while my Outland Spousal visa application is on process.

You can always try , however they don’t apply “ mercy “ to applications, it’s based upon the facts presented

In my experience, I think you can apply(ONLY) for your wife's PR only through 'Spousal Sponsorship'
And you cannot apply any other type of Visa (TRV/Visitor Visa).
Regarding refusal - be honest in your application. if they find that you hid your refusal, it will be considered Mis-representation, your PR may be revoked and you will be banned from entering Canada for 5 years.

Yes spouses can apply for TRVs becsuse some actually come for a short visit and return home. You need to have quite a lot of proof to be approved.
 
Not sure if anybody else had this issue ever, I applied for spousal sponsorship for my wife in January 2020. Due to this current Covid situation, I applied for TRV yesterday for my wife. I noticed today that they have updated the biometrics, however, biometric number is different from what was given during spousal application. Also the date on the biometric uploaded states October 31, 2019 but she gave on March 14, 2020. Also, they have changed the last name to something else as well? Did anybody ever had an issue like this. Any recommendation on what should be done? I have raised the web form but haven't heard back yet.
