Hey Guys,

My wife is in Canada on visitor visa since last 5 months. She would complete 6 months by July end. I have applied for extension on July 7th. Processing time seems to be 29 days.

1. Can she stay in Canada till we hear about the result of our application ?

2. Can we cross to US for re-entry to Canada ? Will that work ?

Thanks,
Anil.

Until you hear the outcome of the extension, she is in Canada under what is called Implied Status.

Just in case of rejection, how soon should she leave ?

Also, can we just cross to US and do a re-entry ?

Thanks,
Anil.

Have you applied for PR?

If you cross the border, there is no guarantee that they will let her back in to Canada.

Is she an American citizen? Or is she from another country whose citizens do not require a visa to enter Canada? If so, then she could just go to the USA, then reenter. Usually people who don't need a visa are let back in. She should be clear that she is just visiting, and bring proof of the PR application, or proof of her ties to her home country.

If she leaves Canada and then comes back in, her application for an extension is over - the reentry will reset the clock, and she will have another 6 months (or whatever the border agent gives her).

She is from India. I have sponsored her under Family class and the file is currently being processed in delhi.

Does she have a multiple-entry visa? If she is just here on a single-entry TRV, then she will not be allowed back in if she goes to the USA. Just wait until you find out if her extension was approved.

How soon she has to leave in case they reject the application ?

As per my knowledge, US and Canada they treat as one country.
I mean : Crossing Niagara border doesn't count as leaving Canada. Person has to travel other than US to re-enter to renew Visitor Visa status.

Completely wrong and pretty stupid.

Canada and the US are separate countries. If a person travels to the US, they have left Canada.

If they reject it, it will say so also on the paper when she has to be out of the country.

Hi canuck_in_uk,
I don't think you need to be so rude in your response.

Have a look at the below statements from cic website :

What is the difference between a single and a multiple entry visa?

If you need a visa to come to Canada, you can apply for a visitor visa (also known as a temporary resident visa). There are two types: a single entry visa and a multiple entry visa. Both are valid for a fixed period and cannot be used after they expire.

A multiple entry visa allows visitors to come and go from Canada for six months at a time, without having to reapply each time. It can be valid for up to 10 years, or one month before your passport expires, whichever is earlier. You must arrive in Canada on or before the expiry date on your visa.

A single entry visa allows you to come to Canada only one time. Once you have left Canada, excluding travel to the United States and St. Pierre and Miquelon, you will need a new visa to travel back to and enter Canada.

If your visa is still valid and you are travelling only and directly to the United States (including its Territories and Possessions) or St. Pierre and Miquelon, you do not need a new visitor visa to return to Canada.

Starting on February 6, 2014 (00:01 EST), all visa applicants will automatically be considered for a multiple entry visa. The visa officer reviewing your application may be able to give you this type of visa even if you applied for a single entry visa.
