Hi folks,

I applied for my common-law sponsorship inland about two weeks ago. I also applied for visitor extension in the first week of March due to another reason. Now, I am worried that they would refuse my application for visitor extension because now the reason for extending my stay has changed. Previously, it was because of receiving a job offer, but now the employer decided not to process it.

I am expecting to get an answer from CIC for my visitor extension in about two to three weeks, when my sponsorship application is still in the pile awaiting to be processed. So it would be possible that they have not seen my PR/OWP application by then. I know I will have to leave if this happens. So I am wondering how I should manage this situation?
Can I leave Canada and come back in two weeks? Will this affect my sponsorship application? My understanding is that I am supposed to stay with my partner no matter which route I applied through (inland or outland) because of the definition of common-law partners (???). I know a short period of time may not change my status, but I want to know what other options I have.

Please help and advise me what to do. Thanks in advance

You won't have to leave immediately if the visitor extension is denied. You could apply for restoration, submitting the PR application receipts as proof for reasons why.

Don't leave yet.

Do I get a chance to restore my status? I saw somebody didn’t even get a chance to do so. It wasn’t mentioned in his/her refusal letter.
If I had to apply for restoration, does it mean my OWP will not be processed until I regain my status? I heard that it will take about 4-6 months to restore one’s status. Is it correct?

Wait for the result. If refused, apply for Restoration. Do not leave Canada.

Outland common-law partners are not required to be cohabiting.

Thanks for your reply.

If you have no status when the OWP app is reviewed, it will be refused. You could try applying again but may not receive the OWP until after AIP.
