My new husband, who is an American citizen, applied for a temporary visitor extension after being in Canada for 6 months. Originally he came in December for Christmas and my birthday in January, and he ended up proposing to me. After that, we decided for him to stay the full 6 months that he was stamped for in order to plan our wedding in-person and have it near the end of the trip in warmer weather. We got married on May 6th, 2018. He came on December 14th and his stamp on his passport is June 13th, 2018.
We ended up applying for a visitor extension and it was sent off last week. Our reasons for his extension were to have more time as a married couple, and to have time to fill out the PR application in-person. Also, if he gets accepted for a 6 month extension we want to get the medical examination done in Ontario, when it is asked of us, as his state does not have a certified physician. We plan to submit the PR app by August or early September.
The temporary visitor extension got delivered on June 5th, which is good. However, the only thing that I am concerned about is that we didn't have our official marriage certificate in the application. We wrote a letter explaining that since it takes 10 weeks to process your marriage in Ontario, we only have the Solemnization of Marriage. This is a piece of paper detached from the marriage license that was given by the officiant before she mailed it off. This paper has our marriage license number, the signatures of our witnesses, officiant, our names and place where we got married. According to Service Ontario, it is not a legal record, so that is the thing that concerns me. Along with a scanned copy of the Solemnization of Marriage, I included some wedding photos, a screenshot of the tracking of our marriage license to the Office of the Registrar in Thunder Bay where the certificate is being processed. The marriage license was delivered to that destination on May 10th, 2018.
So, I assume that we won't be able to fill out the application, requesting our marriage certificate until 10 weeks after the 10th of May, and that likely takes 5 days to process and then more days to be shipped to us. Likely by the end of July, or first week of August we will have it.
My questions:
Since we mailed the visitor extension and did it by paper and not online, there's around 100-110 days before they make a decision. Should we and are we able to send the marriage certificate once we receive it?
Could only having the Solemnization of Marriage be a reason to deny the application? Could they ask us to submit the Restoration of Status and re-submit the Visitor Extension application, with the certificate?
Other proof in our application:
- Last 3 months of pay statements from my full-time job
- Explanations detailing his visit to Canada and why he is requesting an extension
- Receipt of principal applicant processing fee ($475) and the sponsorship fee ($75)
