so I just called the CIC Office for the first time because my husband *from Kiwiland*'s Visa is expires on the 22nd of December, and we still haven't heard back from his extension and I was going to have to hide him in the floorboards of my house until CIC comes up with a decision.

So I asked them

' If for whatever reason my husband gets denied a visa extension, or can't renew for some reason can he stay here'

they replied

'Yes, he can stay, if he does not have a valid visa at the time CIC makes a decision we cannot reject him because he is not here on a valild visa, BUT it is best he keeps it up to date'

And then I asked

'With the inland application processing times being so lengthy, should we withdraw and reapply outland'

He said
'but your husband is here?'

I said
'Yes but he can go home at anytime too'

And he suggested we just stick with it because it's already in the CIC hands and he can stay here with me no matter what ... he just can't leave :)

woop! I wonder how this will work on my taxes? If I support him with my wages ... it will look like two people live off 55 K / year ... Will I get some sort of crazy tax breaks for supporting two people on one wage ? Just curious don't need the $ but wondering if I would add him on my taxes ...
 
Remember that CIC staff are not always correct with their answers.
If he has applied for a visa extension already, he is here (in Canada) on implied status.

It's just this will be his fourth extension, I figure the gvnmt might stop giving them to him 'then what' lol if he has to leave might as well apply outbound right :) I dont' know if it's my internet or what but whenever I do the search function it times out my browser :(

I did scan the first page, but thought it might be handy info for someone here :)

When did you apply? What is you timeline?

If they have not started processing it you can cancel and apply outland, I believe the forms or at least some of them are different though. Did you include an OWP application? He would have been on implied status and been able to continue working, no need to apply for extension if applying inland. Applying outland you are not able to be on implied status but can stay as a visitor. Yes Sydney total processing time seems to be 3-4 months total! Unlike inland up to 18 months! We applied inalnd as we didn't know about applying outland until only a month ago! Rather annoyed about that and no one at cic call centre mentioned it either. But too late now as I have 1st stage approval, still waiting on the 2nd stage. I have traveled quite a bit so that may have put up a red flag to csis.

Applying outland you can leave but if they call you for an interview it will be in Aussie. Applying inland you should not leave until you get PR. Now there are people who have left and taken all there documents with them and been taken in for questioning at the border, I feel it is safer not to as you never know who you may encounter. This is not so bad for people who are visa exempt but if you need a TVR they will probably deny you. That being said nothing has happened to warrent me needing to leave and if something may come up I may reconsider.

I am not sure that is right (or I am reading it incorrectly).
You are on implied status whenever you submit an application for a visitor visa extension, and there are people applying for outland PR during this time.
 
I was meaning for a work visa, don't think you can keep working if you apply outland and work visa expires? I thought it had to be changed to a visitor visa?
 
If you applied inland Serenifly, they have to give him the extention, no matter 4th or the 10th- he has the right to stay during the whole process. Although if you cancel the inland and apply outland they might deny his visitor visa request to stay while it is processed. Also, if you submitted an OWP with the original application, he doesn`t need an extention, it puts him automatically on implied status as long as decision will be made.
Kris, you are right for outland applications there is no implied status provided until the decision, so you have to extend your WP or your visitor visa before it expires.
I`m in the same boat, questioning whether I should have applied outland, but I will stick it out somehow.
 
I honestly never heard of OWP until i started reading these boards ... When I talked to the CIC guy he said my husband can only get OWP after the first phase (9 months) was approved?

I don't mind being his sugar mumma in the meantime lol :o :o :o
 
Yes, I did not know either and I was very upset when I found out the OWP. I was running a few circles then with CIC whether it is possible to submit it later and getting it attached to the main application with no real luck. Mainly 3 call centre agents said the same- I can send it in but there is a little chance that they won`t reject it. So I have to wait until 1st stage and also pray hard to get it and not being transferred. In my situation it`s even worse, I`m on a work permit and I could continue working and have not much of a worry how long does the whole thing takes. Now, my wp expires in a few days, my employer doesn`t have the new LMO and not supporting the idea of extending it without the LMO, however I`m eligible to do so until Sunday. So it seems I join the visitor section again after more than 3 years.:(

I hope it all works out for you ... My husband had to sell his race car in New Zealand and some other things to be able to afford to stay here with me and not work for the time being ... We were lucky in that senses he had that, I do make enough to support the two of us, but now we're not struggling ... we actually just bought our first condo together last week :) First time home buying, all very exciting (off topic yes) ... What does your wife think of the whole situation? Is she able to support you until you can get your WOP ?

I`m going to be on implied status Kris, I submitted already a visitor visa request, because I wanted to secure myself. I don`t really understand my employer`s point of view, it would cause no harm for them to keep me working with the extention. They are firm about having the positive LMO in their pocket, so I have to wait and go to the border to get a new wp once my visitor visa is granted and everything works out fine. I had time to go over and over it myself and there is about 3 month to go until AIP, worst case I`m not going to work for a few months.
Serenifly, actually I`m the wife. :D My husband`s income is way enough for us, so we not going to have a financial breakdown. ;) I`m in Canada for 3 years and I was working from the begining. I just want to work and feel useful, this process is taxing on everyone and work+everyday life keeps it more manageble. Congrats on your first house! We had ours last year and have a 6 month old baby too, so my life is in an exciting fase.
Kris, I check all the time whether you got your the landing appointment or not, wish you to happen soon!
