Hi,
My parents just received their visa for immigartion to Canada after almost 6 years of wait. The visa has an expiration Date of 4th january, 2013/but my brothers wedding is fixed for 2nd week of january, which makes it very difficult for them to leave everything in above situation..What will be their options, Can they apply for extension or do they have to come before the visa expires .... Please help!
I also contacted some local immigration lawyers but they all have different answers..
 
Unfortunately extensions aren't granted. They need to land in Canada before the expiry date on their visa. Otherwise the visa will become invalid and they will have to apply again from scratch. They can land before the 4th and then return for your brother's wedding immediately.
 
Would that mean , they could come for 3-4 days & return back & still be able to mainatain their status to apply for PR whenever they decide to come back or Would they have some time limit to retun back to Canada? Thanks
 
They have to come to Canada by the expiry date on their visa (sounds like this is January 4th). Once they have arrived and landed and become PRs - then can leave immediately (the same day or next day if they want to). After that, in order to retain PR status, they must live in Canada two out of every five rolling years.
 
So don't they have to wait for their PR card to come which takes appoximately 8 weeks.
Lot of people who goes back always get their PR cards.So it means hey can leave and then someone can bring their PR cards to home country and then they will travel back to Canada.As they must need PR card or valid visa to come back.right?
I would like to know too because I am not too much familiar with this.
 
No - they don't have to wait for their PR cards.

A family member in Canada can mail their PR cards to them once the cards are ready.

Alternatively they can apply for a travel document which will allow them to return to Canada without their PR cards.
 
Wow thats great for people who want to go back for some reason.

In principle yes, but they need to allow enough time during their trip to get a "permanent resident travel document" from a Canadian visa office near the city where the wedding will be. Check the visa office website for approximate processing times for in-person applications.

An alternative would be to travel to the U.S. and cross the land border into Canada by private vehicle (or on foot).

The travel document is necessary only because airlines, bus companies, etc., won't let them board for Canada without it or a PR card. At an actual border crossing into Canada, the authorities don't need it to let your parents back in.

The time limit would be three years! I don't think the wedding will last that long.
