My vistor visa expired while i was in Canada. I decided to went back to my country(USA). I have been here for 3 months. My husband is a PR in Canada and we have mailed the outland app sponsorship for my permanent residence. We have a canadian-us baby together and he's with me in USA. Will they let me come back to stay in Canada with my husband and baby until the process finish even if i overstayed in the past? Thanks in advance for the advices!
 
Canada does not know when you've left unless you were deported. Did you have a visitor's record (a piece of paper stapled into your passport?) I would just not mention that you've overstayed in the past and you should be fine, provided you have proof of funds and health insurance.
 
Thanks for the reply. No i don't have any visitor record. Not even a stamp in my passport. But in the app we did mention how long i was in Canada. We didn't wanted to lie about it.
 
That does not mater POE cant see your app all they can see is that you applied.So if you want to come back go to the POE and try,US citizens rarely have a problwm coming in to Canada,just bring your proof you applied for your PR,and proof you intend to go back home after the visit.But chances are you wont have a problem.
 
Thanks iarblue! sounds good...but about the proof showing im returning? maybe a fligth ticket? i would like to stay until they grant me the PR. Rigth now my husband is supporing me, cause im taking care of our baby.
 
Actually they generally will let you stay while you wait if you're coming from the US so you won't necessarily need proof that you are leaving, just proof that you won't be a drain to society while you are there. Since your husband is coming with you, just have him vouch that he will take care of you while you are there (bring proof of funds) and have proof of health insurance for say, 6 months in Canada.

I would not bring a truck full of stuff though. Some stuff is fine, just don't bring everything or have your husband do it separately.
 
Thats not exactly true.They may give you a visit stay of 6 months but you still need to prove you will leave after this visit,even though you may apply for an extension you still need to prove you will leave after your visit.
Proof is yes a return ticket,proerty back home,a job you must return to,etc.
 
Thanks for the replies! So if i understand even if my husband is with me and we filed a app for PR, i should present at the border proof of funds, return ticket and evidence of health insurance!
 
It doesn't have to be a return ticket, it can be something else that you have to do back home, a doctor appointment, a job interview, anything that shows you need to go back home after some time.
I don't see how a return ticket would apply as it sounds you would be crossing back with your hubby by car :)
