Hello All,

I am sharing a personal bad event that occured wth me n i need urgnt guidance. My father-in-law passed away today and i need to send my wife back to our home country. Unfortunately we are on implied status and my BOWP is in process. I applied in Nov 2015. My question is that if goes back and i stay back will she be able to get the TRV inour home country once the BOWP is approved sometime in March or April...will she be able to join me back after getting the TRV....

Sorry, can i request a response a bit urgent....

Call CIC and explain your situation.

I was returning from abroad and asked the same question (can I return to Canada if I have implied status) and got following answer from Canadian Border Officer -

1. It's possible to return if you have implied status from US by car (there might be certain conditions preventing it, better to clarify from CIC).
2. It may be not possible to return by plane to Canada, I was advised to contact CIC for this particular case.
 
Thanks for ur quick response...but i m hoping that i will have my BOWP approved in couple of months and my family has been added as dependent in my application...so once i recieve my approved BOWP, can i apply my TRV here in canada and for my family back in home country?
 
If you are staying back, you can get the BOWP in the mail right? Once you get her BOWP, mail it to her in your home country.
She can apply for the TRV from there.

The OP (ABS) is the principal applicant, so only he is eligible for the BOWP. She might be eligible for a dependent open work permit, but he didn't mention applying for it.

Yes, he can apply for the TRV in Canada, but his dependents in the home country must apply there.
 
Thanks guys for your response...Jes is right...I am the principal applicant...Hence applied for BOWP...for my family...I just filled the form to extend their stay as Visitor based on my WP....So once my BOWP is approved, I will file her visa in my home country....
