Hi
I am now in USA on student visa I wanna go and apply asylum in Canada.

My cousin is in Canada can I go there and claim asylum.?

I think your refugee claim will be immediately refused due to the Safe Third Country Agreement. This agreeement states that you must claim refugee status in the first safe country you reach. In your case this is the US.

http://www.cic.gc.ca/english/department/laws-policy/menu-safethird.asp

A cousin is not an immediate family member and for this reason I don't believe your refugee claim will qualify under the family member exemption.

If you wish to apply for refugee status you should do this in the US.

What if I get work permit in canada can I go an apply there.

Are you a genuine refugee or just want to escape from Pakistan cause you dont like your country?

If you get a work permit for Canada, you can certainly come to Canada and work. But it changes nothing about applying for refugee status.

If you want to apply for refugee status, you still need to apply in the US since this was the first safe country you reached.

well there are some ordinances ans laws against my sect in my country. And We face persecution in our country. I am doing ACCA and I have copleted 12 papers out of 14 but in usa ACCA have no value thats why I wanna apply for Canada not in USA.

Document holder exceptions

Refugee claimants may qualify under this category of exceptions if they:

hold a valid Canadian visa (other than a transit visa)
hold a valid work permit
hold a valid study permit
hold a travel document (for permanent residents or refugees) or other valid admission document issued by Canada, or
are not required (exempt) to get a temporary resident visa to enter Canada but require a U.S.–issued visa to enter the U.S.

thats why I asked about work permit.

If this is all you have - then you would have no hope of being accepted as a refugee. You need to prove that you yourself have been attacked, threatened, etc.

Quite frankly, if you're able to secure a job in Canada that is either skilled or semi-skilled, then you should work at that job for a year and then you'll likely qualify to apply for PR through the Canadian Experience Class program. That's a far far far better option.

It really doesn't sound like you have what it takes to be accepted as a refugee. And if you're refused and sent home, you're pretty much guaranteeing that you will never be approved for a visit, work or student visa to Canada in the future.
