Hi everyone, friend of mine, got spousal work per through her wife. After that she dropped off from school, his wife got spousal work per under my friend. my friend is principal nominee for PNP and Federal PR. His wife dependent. They has 4 months old baby. She was abusing mentally, physically & financially. Suddenly she call police, but when police came , she told cop she hit my friend & police found evidence , initially they found his wife guilty & layed charges against his wife. Now what would be my friend immigration situation?
Please it’s an emergency

thanks everyone.

Your should really speak with a lawyer. If there are charges against the wife, this may impact the processing of the PR application.

This isn't a straight-forward situation. You really need advice from a lawyer. This isn't the sort of matter that you should be relying on advice from a public forum to determine your next steps. None of us here are lawyers.

@scylla but there wasn’t any fault of him.She physically abused my friend several times. Police saw everything, they told my friends they don’t have any choice other than charged her.

I understand that. But your wife is a dependent in your PR application and the fact she has been charged may create problems for your application. If one applicant is potentially inadmissible that can create issues / delays for the full application. It doesn't matter if that person is the primary applicant or a dependent.

You really need to speak with a lawyer who can look at the situation in detail, understand what the charges are excatly and their impact, etc.

And even if the relationship breaks down, your friend and his wife are still married (until they finalize their divorce.)
So she is the dependent and part of the application. If she is criminally inadmissible, the application for PR will be rejected.
