Here is the situation:

I am a Canadian citizenship and my wife is holding an open work permit which will expire on Oct.29, 2013.
I am going to file an in-Canada spouse sponsorship application soon .

However, the whole process may take up to 6 months for the first phase and another 6 months to finalize it.

I am wondering if there is anyway my wife can stay in Canada when her work permit gets expired assuming she is not able to renew her work permit. Any way to keep her status legal after her work permit expires?

Anyone, any comments?

As you are applying inland, your wife needs to submit an OWP app along with the inland PR app. Submission of the OWP app (must be before expiry of her current permit) gives your wife Implied Status once her current work permit expires.

Implied Status allows her to stay in the country until a decision is made on that OWP app after sponsor approval. Once you are approved to sponsor (takes 6-8 months), her new OWP will be valid.

And because she currently has an OWP and will be applying for another one, she can continue to work the entire time she is on Implied Status.

1. What's OWP? Is that Open Work Permit? My wife's Open Work Permit comes after she graduates from a Canadian School. Is that a different kind?

2. Where can I file Open Work Permit application in CIC website? I checked CIC and only find the form to extend stay as a worker.
If I pick the open work permit, do I need to provide a LMO and detailed Employer information?

3. How do I need to submit? Should I submit it through paper or electronically?

1. Yes, OWP is Open Work Permit. Guessing your wife has a Post Grad Work Permit, PGWP? I believe (though you should confirm with CIC) that going from PGWP to OWP still provides the implied status that allows her to keep working.

2. You found the right one, http://www.cic.gc.ca/english/information/applications/extend-worker.asp. You don't need to put an employer or provide an LMO, as it is an open work permit. Across the top, write something like "OPEN WORK PERMIT FOR INLAND SPOUSAL SPONSORSHIP, NAME, DOB".

3. You will need to submit it with the PR app, so paper.
 
Thanks yes hers is PGWP,so how to confirm with cic? Call the 800 number?
