Need urgent advice

We were nominated through OINP last month with a CRS score of 414, and five days later (June 23, 2025), we received an ITA, which added 600 points to our score, bringing our total to 1,014.

As we were in the process of gathering documents for eAPR, I just realized that my spouse’s IELTS had already expired on June 18 which is prior to receiving the ITA.

We’re now worried that this might be considered misrepresentation, since the IELTS was already expired at the time we received the ITA (not after ITA) My spouse has retaken the IELTS, but unfortunately, the new score is lower than the previous one.

We’re unsure what to do, should we decline the ITA to avoid the risk of being flagged for misrepresentation, or should we go ahead and submit the new IELTS result along with a Letter of Explanation (LOE)???

We only have 2 weeks left before the ITA deadline. Thank you so much to anyone who can help us.

You very likely meet the minimum CRS cut-off score even with the new IELTS. If that's the case, you got nothing to worry about.

It is a very easy to find info on the forum or Google. Why are you thinking about "declining the ITA" for misrep? Is is purely ignorant and foolish to do so! You don't need a LoE for this at all as long as you meet the minimum cut-off for the draw you received your ITA for.
 
Thank you for your reply. Our concern is the information given at the time of ITA, should be accurate and should match the IELTS result given on our express entry profile. Our EE is locked and I can't update it now. Just hoping that's not considered misrepresentation.

Yes, but scores can change and that's why they are not misrep. As long as you meet the CRS cut-off they can't deny you your application. Misrep rather is something that you do to get the PR, in your case you didn't materially faked any info to get the ITA. Your 600 points were enough to get you the ITA :D

Don't take my word for it. Search the forum, you'll see many like you whose post ITA language scores changed and they submitted with new IELTS and got the PR. My spouse gave IELTS on the day we got our ITA(we got ITA later that night), we added that IELTS score to our profile after getting the ITA and got our PR.

If the forum data isn't helping either, take a $150-250/hr call (10 minute would be enough) and you should hear an immigration lawyer in Canada tell you the same.

You can follow through all steps to get a peace of mind. Don't decline this ITA.
