Hello,

My parents are overseas and have not been able to come back due to Canada- they are about a few weeks short of the 730 day requirement. My parents both had emergency medical surgeries and have been in rest for a long period (six months). Could they lose their status? Is there anything we can do?

The advice in brief will be to return to Canada as soon as is feasible. If they run into questions or issues, explain the medical reasons (and be prepared to document). If they still have valid PR cards, and return before too long, their chances will be better. They will at any rate be admitted to Canada - at worst they would be reported with a right to appeal.

Now if you want to run and ask about a whole bunch of different scenarios: read through the threads here and see what's happened to others. The bottom line advice will still basically be: they should return as soon as feasible. The rest gets complicated, especially if they do not.

Thank you! I am stuck then....should they abandon their medical care. My mum cannot move and been advised and air travel. Please help! Also is it immigration office who can cause trouble or even after later on?

If they cannot move, they cannot move.

The way it works is that they retain their status as PRs, even if out of compliance; the issue of whether there should be action taken on the RO compliance is effectively never considered until they either present at a port of entry, OR apply for a PRTD to return to Canada (if PR card is expired).

The point being that there is nothing in advance of being ready to return that they can do, apart from at least retaining basic evidence that they have medical conditions etc that prevent them from returning. Take care of their health for now.

In the longer term, the short form is that IRCC usually is lenient in cases of serious medical issues that prevent travel. But until they're ready to return to Canada, the issue is basically suspended - not relevant because they're not returning now. And no-one here can say for certain except that actual hospitalization usually does indicate something serious.
