Hi All,

My friend who was deputed to Canada on an ICT visa (Closed work permit) had claimed 50 points since he had a job offer with a 1 year validity.
He received the ITA but due to COVID and some personal issues he couldn’t submit the documents. He is now ready to submit it but is a little worried if IRCC would reject his application since his job offer is expiring in 8 months. Will this be a cause for concern? When he applied it was valid for year though.

He's in Canada with his wife, working for an Indian MNC.

His contract would be renewed most probably early next year around March for another year.

Should he wait for a new draw after March? Will it be a problem for him if he gets rejected now and gets an ITA in March?

Kindly reply soon, he's been hesitant all this while and his ITA would expire in a couple weeks.

In order to claim the 50 job offer points, his employer needs to provide him with a letter stating that they will continue to employe him for a year after he becomes a PR.

Hi, Thanks for the reply. But as I mentioned he has the job offer which will expire in 8 months. Will it be an issue since a 1 year job offer is required. When he entered the express entry and claimed the points the job offer was valid for a year. Since 4 months has passed now, it is valid only for 8 more months. His contract would be extended only in March next year. His current job offer is valid till June end 2021.
 
Job offer must state that it has to be valid “AT LEAST one year after PR visa was issued”. Your friend won’t be able to claim 50 points. You can search for other posts in this forum. Officer is looking for this specific phrase in the job offer.

  • if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
    • are currently working for an employer specified on the work permit
    • have one year of full-time work experience (or an equal amount of part-time work) for that employer
    • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

I read the details of your post the first time.

Again, he needs a letter from his company that specifically states that they will continue to employ him for at least one year after PR. This is what he needs if he wants to be sure he can claim the 50 points.
