HI Guys,

I am the permanent resident and next year I will be married(arrange marriage) in Nov 2017 after that I want to sponsor my future wife. I have couple of questions regarding my case and I would be grateful if I can get best possible answers, so please refer below questions:

1) We met last year Feb 2015 in India and we started conversation after that I came back to Canada, Now I am in India and we are doing engagement. Next year again I will be coming back to India for marriage in Oct 2017, So by the time our relationship will be 2.5 years old till marriage . Does it looks good in the eye of immigration because we have given at least one year for each function , first we met then engagement and finally marriage ?

2) Secondly, Me and my fiance has 6 years of age difference, when we will go for marriage I will be 26( 3 months will be left for turning 27) and she will be 20( 5 months will be left for turning 21), does it will be having any negative impact in the eye of immigration department ?

3)Thirdly, In next year November she will be in third year of her graduation and for India processing time is 18 months , If I will apply for her in March 2018, during her processing time of spousal PR visa she will complete her remaining 1.5 year of studies so everything would goes with time......Does it will be having any negative impact on officer because her more than 1 year of studies will be left and simultaneously her sponsorship file will be in process .........?

4)Her father committed crime which is related money fraud and was in jail before but now he is on bail, but my fiance didn't committed anything, when it was happened she was only 17. Does it will be having any impact on spousal sponsership............?

Need expert advice , because this is the matter of someones life ...........

Thank you in advance ...

1. This is fine. For an arranged marriage in India, the visa officers would be satisfied with much less time than that. However, getting to know one another and taking your time, especially considering the age of your fiance, is a good idea.
Keep proof of your communication; proof of all trips taken to visit her; proof of how the marriage was arranged; and all proof of the engagement party and wedding ceremonies. Visa officers in India expect to see a big traditional wedding ceremony when the marriage is arranged, so if that is what you have planned, great. If not, you will have to explain why you chose a smaller wedding.
2. This age difference is fine. They would be concerned if the wife was 6 years older than the husband, but the wife being younger is considered normal. Since it is an arranged marriage, the visa officers will be looking for anything that would seem strange according to Indian customs. This age difference with a younger wife is normal.
3. This will not matter.
4. This will not affect the processing. Her criminal history is what is important. Her father's criminal history might affect her if he is part of organized crime or a terrorist organization. Even then it would probably only cause her background check to take longer. If it is just a 'normal' crime, it will not affect her chances.

Engagement party will not be that big , it will be small party but we will take photographs of engagement ceremony , does it will be enough ?

However, her father committed crime which is related money fraud, I don't think it is normal. PLEASE tell me it will not affect her sponsorship application ?

DO I HIRE A BIG IMMIGRATION LAWYER................. IT WILL HELP ME TO DEAL WITH SUCH SITUATION.

Thank you in advance

Thank you in advance

all you can do is submit proof of what you have. no one can tell you what will be "enough".

the criminal history of the sponsor's or applicant's family members are not relavant to the application. only the criminal history of the applicant and sponsor are.

not sure what you need an immigration lawyer to help with. you can receive better help by asking your questions here. again, your wife's father's criminal history is not relavant to your spousal sponsorship, so there's no reason to seek legal advice about it.

The small engagement party will be fine. Take photos.
Her father's crime should not cause her application to be refused. If he were a powerful gangster or a terrorist, then yes, this would cause delays while the government did a more thorough background check. But her father's fraud should not cause them to suspect your fiance of any wrongdoing. There are questions on the forms about her criminal history, if any. They do not ask about her parents' criminal history.

I don't think you need a lawyer. You can ask questions on this forum. If you feel better having a lawyer as well, then of course it won't hurt. If you decide to hire a lawyer, just make sure he or she is an immigration lawyer.
