Hi Friends,

I have received my Visa in September first week (Visa is valid till June 2013) from CHC SINGAPORE.

Recently one of my relative in Canada inquired from the Immigration Office within Canada that it can take 2-2.5 years for the PR Process for the child born outside Canada to PR Parents and during that time child will be on visitor/temporary visa. Parents will have to take care of the medical and insurance expenses. I want to confirm the same from my seniors members here.

My wife is pregnant and delivery is due in March 2013. Initially I decided to to complete the Landing process in November 2012 and go back to India for delivery and then move permanently to Canada after few months?

Please help/advise.

Regards,
Pankaj

Re: Urgent Help required - Seniors qorax, Leon, Wilson & ankit Please reply

Hi Seniors,

I am waiting for your reply. Can anyone please explain me what immigration relates procedures one has to follow to sponsor the child. I have read about TRV/TRP and sponsoring the child from within Canada by parents.

1. What are the chances of getting TRV/TRP. We are planing the delivery in India. I am Indian Citizen living and working in SINGAPORE (CHC Singapore).

2. How much time it takes to get the approval for TRV/TRP? In case TRV/TRP is approved, baby can enter Canada and parents can apply for child's PR.

3. In case TRV/TRP is rejected, one has to go to Canada to sponsor the child. Is this sponsorship is for PR, If yes can parents bring their baby into to Canada during this time?

Regards,
Pankaj

1. No it doesn't take 2.5 years. Is your spouse going to "land" or just you? If it is just you, then you will have to sponsor the child and your wife, once you return to Canada.
2. It is very unlikely that the child will be given a TRV to come to Canada. As his/her intention is to remain permanently.
3. So once you return you will have to sponsor the child through Mississauga and New Delhi.
4. Fairly quick processing, minimal medical, no blood tests, no x-rays, no background, police or security checks. Getting the child to sit for the passport and immigration photos will be the hardest part.

Hi PMM,

Thanks for your reply.

1. With Initial plan me and my spouse are planing to land in November (From Singapore to Vancouver) stay there for two weeks and then My wife will go to India and I will return to Singapore for my job. Delivery is due in March 2013, once we get the passport for our child we are planing to bring the child to Singapore, and then we will plan to move to Canada permanently in May/June 2013 - Here we will need a valid visa for our child to travel to Canada with us.

2. As mentioned in 1. if we (child) have intentions to remain permanently in Canada is there any chance of getting TRV or "TRP"?

3. In case we get TRV/TRP, child can travel to Canada with PR Parents and PR Process can be completed while the child is in Canada. Is this correct?

Pankaj

You can try for a TRV for the baby but it will most likely be refused because your intention is not for the baby to just visit Canada, you are going to stay. A TRP may be issued for a baby of PR parents. I have seen a few cases of TRP being issued for that purpose. If you get it, you can bring your baby with you to Canada but you will still apply for the baby's PR through India. Not that it matters.

The baby may be covered by healthcare if it is on a TRP but definitely not if it is on a TRV. You have to look into that and get a travel insurance or other emergency insurance for the baby in case something serious happens. Regular doctors visits, vaccinations etc. you would have to pay for out of pocket. For yourself and your wife, depending on which province you are settling in, you may also need insurance for the first 3 months as you wait to be covered by healthcare.

If you are unable to get a TRP for the baby, you must go to Canada to sponsor but leave the mother and baby behind. Regardless of your wife waiting in Singapore or in India, you should apply for the baby through India because it is way faster, see http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp#asia

Those processing times are for spouses, 80% of applications processed by X months but a baby should be faster, simple medicals, no background checks. Add to that some 2+ months in the beginning that Mississauga would take to approve you as a sponsor.

Thanks PMM and Leon for detailed answers.

Pankaj

Hi Leon,

I have a small doubles.

In case of TRV, child can travel with us to Canada, Can we apply for Child's PR sponsorship from within Canada either through in-country office or India?

Is TRP a simple process or it involves any special approvals? Can we apply for Child's PR sponsorship from within Canada either through in-country office or India?

As you said for sponsorship, it can be applied only from within Canada, my question is will I be able to travel outside of Canada while sponsorship is in process?

In case of TRV or TRP or child staying in India, you must apply through Mississauga and India for PR because children alone can not be sponsored inland. Only a spouse with/without children can be sponsored inland.

I do know know if TRP is a more special complicated process than something else but I believe the process is you try a TRV for the child, if they refuse, you can try a TRP based on your special circumstances. You have to talk to the embassy about this.

As a PR, you must be living in Canada in order to sponsor family members. If you make a short trip to Canada just to file for sponsorship and then leave again, if immigration finds out, they will cancel your application. However, you should be ok to take a quick trip outside Canada, say couple of weeks vacation during the processing time. However, make sure you have someone checking your mail and messages for you in case immigration wants to get in touch.
