i applied for PR card renewals for myself, wife and six-yr old son in march 2011 but before we could get the new PR cards, we had to travel back to our home country due to a family emergency - which later turned into a tragedy as my mother passed away in june 2011. by this time, my wife was into her ninth month of pregnany and we were therefor forced to dilever the baby in our home country in july. since then, our PR cards have been renewed. however, now tht we are planning to travel back to canada, after dealing with various domestic issues (an elderly father being on top of the list) we find ourselves in a dilemma since our newborn child has no legal status in canada - neither does he exist in thier system.

kindly guide me abt the options i have that can help us travel back to canada with our baby as soon as possible... can he be issued a PR card on the basis of being a minor dependant baby of PR card holder parents? kindly reply asap as it is extremely imp tht we fly back to canada - esp since school has started in canada since sept n our elder son is missing out on his grade one...

What country was the baby born in? You will have to sponsor him, but he will most likely be able to come with you to Canada on a TRV or a TRP. If you are from a country where you don't need a visa to enter Canada, he could just come as a visitor.

You will need to sponsor your child. To do so, you will need to be in Canada, which is of course the challenge, since you would like to bring your child back to Canada with you.

You will need to obtain a TRV for your child. If the VO refuses to issue a TRV (because they don't believe the child will leave) you will need to request a Temporary Resident Permit (TRP) to overcome this inadmissibility. This will certainly sound odd, but I've read several cases of this type - where the family wants to bring the child back with them and then apply for PR. In general, a VO will grant such a TRP.

The other option is for one parent to return to Canada and initiate the application, while the other parent remains outside Canada with the child. Note that sponsorship applications for minor children are generally very quick in terms of processing, but it is still likely to take 6+ months to complete the process.

Young children have minimal medical exam requirements and do not need to submit PCCs. As I recall the application fee is smaller as well.

My suggestion:

- Apply for the TRV (this will require that your baby have a passport)
- one parent return to Canada with your older child. You are both PRs and have PR cards, so you won't have any problems returning.
- If the TRV is granted, have the other parent and child return to Canada as well
- If the TRV is refused, request that the VO issue a TRP for the child and include a copy of the PR application you have submitted.
- If the TRP is granted, have the other parent and child return to Canada
- If the TRP is refused, have the other parent wait with the child outside Canada for PR to be granted

Note: I've never done this, I'm merely basing this upon my review of other, similar cases.

thankyou so much for your quick replies... i have one more question in mind though and was hoping you could help me out in this regard... since my mother's death, my father is alone now in my home country pakistan. i am the only son and now that you have given me hope regarding my new born's entry into canada, i was wondering if i can delay my return - owing to my father's possible super visa process, wrapping up property matters etc.
so my question is:
can i apply for my son's TRP or TRV or even sponsorship after a year or so? let me clarify that i willl also be staying here in pak along with my wife and older son... we have recently-renewed PRs and can afford staying out of canada for another year im sure... i just feel tht im at the juncture of my life tht i need to move my elderly father at the top of my priority list... i hope you can understand.

As long as you are in compliance with the PR residency obligation, you can remain out of Canada and settle your family's affairs there. Just keep in mind that if you fall out of compliance (730 days in the past 5 years) that while a valid PR card is likely to get you back into Canada, you won't be able to sponsor your child - if you do, they are very likely to investigate, find you in breach of the PR residency obligation and serve you with a removal order.

So you've already been absent from Canada since June 2011 (16 months) your problems will begin when you have been outside Canada for 156 weeks. You're about 70 right now (since June 2011). If you had absences in the two years prior to June 2011, you should keep those in mind as well.

One more year (52 weeks) should be fine, assuming you were in Canada continuously prior to June 2011. But if that stretches into 18 months you will start to have problems, especially if one of you must remain outside Canada while the other sponsors the child from Canada.

does this apply only in the case of when i want to sponsor my child or will this also be the case in the event that i apply for a TRP?
correct me if im wrong: does a TRP take less time to process versus sponsorship of the baby in which case there is a 6+month wait n i will have to leave my family back in pakistan?

I have sponsered my husband in April 2011 and since then our file was first transferred to Vancouver office and now it is transferred to Etobicoke office on october 24, 2012. Could anyone please let me know how long we have to wait to get an interview call.
