Job Offer........
Pre-Assessed..
Hi all,

I had H1 B visa in US but got laid off in march 2010. Then i got admission at the University this fall. I have an I-20 so i can be legal and wait for spouse PR. I applied PR in April 2010 and it has been moved to LA office in August 2010.

Now, I don't want to go to the University and pay $8000 tuition. Is it ok to be overstay in US if i don't join University? Does it effect the immigration process in Canada? Is there any way I can be legal for couple of months because my I-20 will expire next week ?

Thanks in advance !!

Do you already hold a Study permit for the US? Is there no way you can apply to remain in the US just as a visitor?

I used to hold F-1 then i got transferred to H1. Now i cant apply for visitor visa in US bcoz its too late and they will definitely deny it..

Will you have an implied status in US if you applied for one? Even if they deny it will it not buy you a couple of months whilst waiting to hear from them?

In Canada when you apply for a Visa you have whats known as Implied Status..this means you can legally stay in Canada until you are told to leave or given your visa..this usually takes 100 days..I was wondering if you can do the same in the US? Or do they process visa's faster in the US? I was just thinking it could give you enough time to get your PR

Whats your country of Citizenship? Can you not visit Canada?

can`t you attend a less expensive university?

You need advice about maintaining your US status. There are some similarities between Canadian and US immigration law but also some major differences. You might want to search for other forums that focus on US immigration law because we may not be able to give you proper advice or information here. Best of luck.
