Hello,

I have some questions to ask, according to IMM5540E on Q11 on the sponsorship form (PRV outside Canada, Family Class: Spouse).

My husband has been living outside Canada for 5 years. We both have been living together and legally admitted to live/work here in Australia for more than a year, so my husband has already submitted our PR application to Missisuaga, but we realised that we might miss a letter explaning in his intention to re-establish in Canada in Q 11.

He has provided and submitted his proof of intention to re-establish in Canada such as 1 company letter issued by HR stating when he has been employed until present in this location and the tax payment has been filed/paid in the current location, including his salary annual income and current position. Another company letter issued by his upper direct managment manager stating he will be returning to work in Canada and effective by Jan, 2011, and the office location will be finalised in December 2010.

As you can see we cannot provide the exact date and location he will be relocated. Apart from that, we have submitted 2 letters from his family and friends stating they know our returns and his family is happy to have us to live with them until we can find/arrange our own place. My husband did not write/submit his own letter stating his intention when,where, how, what to do if I get PRV, but he wrote a little on the cover letter covering those proofs to show he's been employed outside Canada and the proofs showing/explaining themselves to explain enough that he wants to return to Canada. We are worrying about that as most people did, but we did not.

Do you think we have provided/submitted those enough proofs to CIC? If not, should we submit his own letter stating that to CIC-M asap? by fax or by phone? Do you think it helps? Any suggestions?

If they require it they will let you know until then and if they do i think you covered it with letters.

I faxed CIC-M regarding an issue of a missing document in my file and did not hear back although I provided several ways to contact me. There isn't a phone number to contact them either. I did fax the documents that I needed to go in the file but I am waiting until I receive some kind of confirmation from them that my application has begun processing because I don't want to send more information and risk losing the originals if they dont get matched up to my initial application. Once I have a file number I will forward the originals to them. I have also heard from others that they dont respond very often to faxed communication so I just thought I would share that with you.

A letter from you might help although it may not be necessary. Now that your application is sent off, you have lots of time to second guess everything you sent or didnt send - I think that we are all doing that. ;D

Thank you for sharing this info, heatherusa. I think to submit proofs of re-establishment in Canada can be one of those specified letters which we have submitted one from employer and one from his family who will provide us the accomodation. Thus, we think that those two letters would be enough (we hope). Maybe I worry about things too much. Let's see, hope we will get PRV soon:)

Yeah it really depends on the visa office some answer some dont.I think they reply only when they request and they dont get.But at their own pace for sure lol.But i think you guys covered it well and like i said if they want more they will ask for sure.

Good luck to you to... I also worry, because we make plans to move forward based on suggested time lines and it is hard to move forward when we worry that there will be something that will hold us up. I suspect that most of our cases are straight forward and it is easy to tell in some cases that the plans to re-establish are real, just based on the information submitted. I also think that there are certain countries where the "threat of deceit" is lower and maybe the details of your relationship are enough to suggest that the spouse being sponsored isnt coming without their sponsor. I wouldnt worry about it. I suspect that if your relationship is documented well enough then you should be OK! Keep us updated.

You are right. That's what we are worrying about, especially the sponsorship part. Once it is approved, we hope the immigrant part will be alright. We think we have covered it all, but we are applying through Sydney, Australia where is different from the CIC office of my nationality. We except and hope to get PRV before we move back to Canada as estimated in the Sydney timeline here.
