Dear Sirs, Madams,

I would appreciate you help and giving me from your time.

We would like to immigrate to Canada as a family but I am concerned about my American wife regarding her situation in her country. She is outside of her country and she has debts left (student debts and others), she also has a child care issue, she is trying to fix these issues but she is not sure if there is any case raised against her, according to her situation, are we allowed to apply for Express Entry to Canada? Is there any problem we may face according to the Canadian law?

Regarding the Bank account as a requirement for the application for immigration through the Express Entry, can I show a financial sponsorship as a bank statement from my brother as a kind of support in addition to mine?

Is it a must that I have to have the bank account for at least 6 months to be able to apply? If yes, what is the least amount of money I have to keep as savings or whatever to be accepted?

Do I have to have a specific type of a bank account (i.e. are there any conditions)?

Can I use my wife's bank account in addition to mine and my brother financial sponsorship statement? Is that helpful or I have to show just my bank account as the main applicant?

My wife is a native speaker of English, does she need to do the ILETS test?

I have a degree with work experience of 3 years, my wife also has a work experience, what is the best program for us to apply to?

Finally, If we apply for a visit visa to Canada, what is the possibility to be given this visa?

The funds you show for Express Entry must be either yours or your wife's - you cannot use your brothers. If there are two of you, you must have a bank balance of at least: $15,143.

If your wife is the primary applicant - then she must take a language test - either English or French. If you are the primary applicant and want extra points for your wife's language abilities - she will need to take the language test to prove her abilities.

Native English speakers will also have to give IELTS. The only difference is that IELTS is optional for co-applicant/dependent. Your spouse can give IELTS, if you want to claim points.

In addition to what scylla has mentioned, please note the following.

1. You can get funds from your brother as a gift. The money will have to be transferred to your bank account and you will have to execute a Gift Deed which states that the amount of money transferred by your brother to you is a gift and not a loan and need not be returned to him.

You will need to submit the following for proof of funds
- Gift Deed
- Balance Certificate on bank letterhead
- Last 6 months' bank statements stamped by the bank
- Letter of Explanation for the gift money

2. The reason for asking 6 months bank statements is to ensure that the applicant has not borrowed money or taken a loan to meet the fund requirement. As long as you can prove that the funds belong to you, it is not necessary that the funds have to be in the account for 6 months.

3. There are no conditions for bank account or the funds, the only requirement is that the funds should be unencumbered and readily transferable.

4. Preferably the funds should be in the name of primary applicant. If the funds are in the dependent's name, then you need to submit the following.
- Self Declaration signed by your spouse in which the spouse should state that she is a co-applicant in your PR application and the amount under question (provide details) are to be used for migration purposes for you as a family and she does not have any objection for the same.
- Balance Certificate from the bank in which your spouse as the account printed on bank letterhead.
- 6 months bank account statement
- Letter of Explanation to explain the above

5. Even native speakers of English should give IELTS. It is mandatory if the native speaker is the primary applicant and optional if the native speaker is the co-applicant in the PR application

7. Applying for a visit visa will not have an effect or improve your chances of getting PR.

Thanks alot Stanlee and Scylla, I realy greatly appreciate you time and help :)
I apologize to take from your time, but I realy have a critical issue and I have aconcern regarding my wife's sitiuation. She left the US since 5 years with some debts as she was a student. Her family forced her to take debts to help them then they left her alone without any support, she is also has a child care issue, but she saw herself alone and abused and she suffered alot after she was ok.

My concern is about if there will be any problem for us or her to apply for the immigration?
Do her debts or her sitiustion make it difficult for her to apply?
She was fine till she was used for the green card then her life became a mess, that can be shown from her credit card. Now she is worried about even trying to deal with her country as she was not able to file her taxes because she is not working.

Does that case effect her inmigration application or aby kind of visa to Canada?

If it is ok for her to go to canada, do you advice us to go on a visit visa and apply for asylum for my so we can stop our critical sitiuation as it is gitting more difficult by time?

Please if you have any idea or know someone can help, please tell me.
