My SO and I "lived" together for 2 months in 2010 (I was just on vacation and we rented a condo)
I officially moved to mexico April.30th 2011. From Oct.1st-Nov.19th I had to travel back to Canada for business/family reasons. Would we still be eligible for common law on APril.30th? What are considered "short absences" it's very vague and we are going to do the medical tomorrow (for 3 children + him so I'm worried now that we might not quality)

Please any insight would be great.

In addition to this,
We tried to get him a visit ( we attempted twice, the second time with more information) both were denied as they weren't satisfied he would return to mexico. We requested 3 weeks. 3 weeks was the time I spent with family. 3 weeks was the time I was there for business/work purposes (i work for a canadian company while I live in mexico) So, I combined both trips as it was less expensive. We would have only been apart for 3 weeks had his visa been approved. Do you think if I explain this, we would be okay??

3 weeks is a short period. I think explaining will be fine.

The problem is, it was 49 days total we were apart. Half of that time was spent with family, and the other half was business since i work for a canadian company.

I'm wondering what people's opinions are...

I'm thinking of writing a short explanation advising of why i had to leave. explain we were declined 2 times for his visitors visa to come with me for 3 weeks, explain half was family, half was business.

But not sure if i should include communication via skype/phone during this time or not. i dont want to draw too much attention to the time we were apart but also don't want to not say anything and get declined on this basis.

Has anyone been in a similar situation? I wish CIC would specify the exact time.

Does anyone know would we be declined during the first part when they say if I'm eligible for sponsoring him or would this have the chance of being declined near the end of the application? (the form that asks the dates you were living together/apart are on the principal applicant forms... not sure if they review those when determining if i am eligible to sponsor or not.)

Thanks for ur help!
