My friend is on study visa in USA for 5 years. 3 years left, She has a child born in US, so is US National.
They are planning to go to canada on visit visa next month, can they apply for asylum after reaching there?
 
Why wouldn’t she apply in the US? Her child’s application will definitely be denied as she is a US citizen. The fact she’s been in the US for several years won’t bode well for her application either. What’s her basis of claim?
 
Do they have a travel visa to enter Canada? They actually have legal status to remain in the US and complete her program. She has studied for 2 years already.

Yes they have travel visa to visit canada. And will plan to go next month.
Actually she changed her masters program to a short diploma course which is completed.
 
Getting asylum is far from guaranteed she must show that her life is at risk. I would consult a lawyer before risking applying for asylum. Once she applies you can’t go back if you get denied. It has significant consequences. Has the family explored economic immigration.

In case of refusal.They cant go back to Canada or US again?
 
They should apply in the US. Their child is already a US citizen and it’s guaranteed the child will be denied refugee status in Canada. Once they apply in Canada, returning to the US will be extremely difficult. And if the claim is denied, it will likely be nearly impossible. They are taking a big risk by leaving the US to claim asylum in Canada, where there are few guarantees they will be approved.

If you get denied your ability to travel or get visas from many countries will be difficult because countries will think that you will be unwilling to leave. Yes if your friends and her family are denied they should expect that future travel will not be possible to Canada or the US for many many years. That is why asylum should be the last resort option for anyone.

You should tell them to look at economic immigration options first plus consult a lawyer because we don’t where they are from and what their grounds for asylum are. Given that they were approved for a US study visa that rules quite a lot of countries with high rates of asylum approval.

Especially if you are from Nigeria, its like a camel walking the eye of a needle. Its so hard to get a positive decision. Be careful.!
