Hello everyone..!!

I am an Indian Citizen. I got my Canadian PR in February 2009, landed on July 2009 and the visa was sponsored by my spouse. But due to certain issues, after a year me and my spouse mutually decided to get separated. I came back to India in July 2010 because I had to look after my mother because of her ill health. I moved to Saudi Arabia and worked there for 3 years as I had to support my family financially. The situation that time was worse and I had no chance other than working in Saudi Arabia and staying with my family. Now when things are settled I want to return back to Canada, but I know its too late for that as I do not meet the residency obligations. I was there in Canada just for for 365 Days.

Still I would like to know if there is any chance that my PR gets renewed, as I have already mentioned the reason behind me leaving the country. I understand that it is not easy but I would like to know what questions that may be asked by the visa officer for granting PR renewal.

Also I would like to know if my spouse would be contacted for my PR renewal as she was the one who sponsored me.

I would highly appreciate for response to my query.

I don't believe you will be successful in renewing your PR card for H&C reasons since you have spent the last three years working in Saudi and this won't be considered as an H&C reason for failing to meet RO. Financial reasons and employment generally aren't accepted for H&C claims.

I think your only real option would be to re-enter Canada by land from the US using your COPR (you'll need a US tourist visa to do this) and then remain in Canada for two years without leaving before applying to renew your PR card. When you re-enter Canada, there's always some chance you may be reported for failing to meet RO which would trigger a review of your PR status and white possible result in the loss of your PR status. But you can certainly try and we've certainly seen people on this forum who have been successful in retaining their PR status by re-enter Canada by land.

You have practically no chance to keep your PR status. Since your PR card is long expired, you would need to apply for a PR Travel Document to even board a plane back to Canada. And in applying for PR TD, CIC would see you don't meet the Residency Obligation and start process to revoke your PR status. It doesn't sound like you have any good H&C reason to keep PR. You could also appeal this, but due to no H&C reason most likely an appeal would also be denied.

If you instead tried to enter Canada through USA land border, due to not having valid PR card there would be high chance of being reported by CBSA for not meeting RO and again starting process to revoke your PR status.

If you somehow got into Canada without being reported, you could then stay here 2 straight years without leaving and then apply to renew your PR card. Of course your SIN would have been deactivated by now so would need to try and re-activate it which may be difficult with no PR card.

None of this has anything to do with your ex-spouse, so she would not be contacted or be involved at all.
