I'm currently in home country since 2020 and would like to come back to Canada as a student again. I am seeking for your valuable input and advice on how to go about it.

Below is the brief background and attached are the profile related documents-

I was in Canada as a student in Aug 2015 for 2 year diploma program in Engineering at Sheridan College. I failed few courses and also, the Professor Strike happened in Jan2018 because of which I had more than 8 months gap and completed my studies in Aug 2019. Post course completion, I applied for PGWP in Sep 2019 however, it got refused. I applied for reconsideration in Jan 2020 but it again got refused in April 2020 citing the same reason even after submitting documents. Then he COVID19 lockdown hit and as, I was not having a legal status in Canada, I applied for TRV/TRP per your advise back then. CIC online portal was not accepting online applications so I applied through Canada post. I didn't receive any sort of update on my TRP and as I wasn't having status and didn't want the deportation tag on me so I started checking for repatriation flight and flew back to India in June 2020. During my stay in Canada I had 1.3 year work experience in my Engineering field from Canadian Company.

Now, I would like to come back to Canada as a student again for a college program. Requesting your advice on how to go about it

Given you have completed a diploma program then you will need to

a) select a program that builds on your education (you have done a diploma 8 years ago, so what are you taking?)
b) justify costs with coming to Canada again (show career progression, higher paying job)
c) convince officers that you will not fail your courses again
d) declare PGWP refusals and TRV/TRP refusals
e) explain gaps in education. Many colleges will not accept students with large gaps between education programs.

Why did you apply for a TRP? You were not inadmissable. Your Canadian experience was during your studies so doesn’t count as Canadian, so not really relevant to new application.

TRP and TRV are not the same thing. TRP are for people outside Canada who are inadmissable to Canada because they have a criminal record for example. You extended your stay as a visitor.

What school have you been accepted to? Some schools do not allow gaps in study for international students because they have lower chances of approval. You could have gone to school online and at home during Covid as an international student, so not an issue. You could have applied while in Canada, been approved and study at home.

You can certainly apply for a new study permit. My comments on the best way to apply:

- Hopefully you have been working full time or studying full time in your home country since returning in 2020. Assuming you have, this will strengthen your application. The program / school you select to take in Canada now should strongly align to your work experience and past education, and also show a progression of studies.
- You'll want to include an LOE explaining your past history in Canada.
- Make sure you mention all refusals in your application, including the PGWP refusal.
- Make sure you mention the periods where you were out of status in Canada before you left (it sounds like that was April 2020 to June 2020).
