Hello... I am new to this forum, and I am glad to find this forum.... I have applied for skilled worker immigration five years ago, and I have included my spouse along and my three sons with me in the application. Recently, the immigration office have asked us to provide them with our medical check-ups, but one of my sons who is a 23 years old is refusing to do his medical check-up. I have contacted the cic and informed them that he has already done the medical check-up five years ago prior to issuing his student VISA, but they told me that it has been expired as it only lasts for one year.. He is already in Canada now, he went on a student VISA four years ago ( I afforded his education) and two years ago he decided not to contact me anymore. Is there a way where I can avoid this problem? Can I cancel him from my application? If yes, what should I do to cancel him from my application?

PS: I don't care if I can no longer involve him in getting the PR.

Hi,

Sorry to hear about your situation. I understand that however/whatever we may discuss here, it wouldn't be a solace & neither lessen your pain. Have patience in the ways of God! These r testing times.

1. Getting all family members to do the Meds is a prerequisite for the PRV. Thus, u can't avoid his meds, if u want to continue with the process.

2. There's no way to cancel his family membership, unless u legally proceed to "disown" him. And that's neither an easy - nor a fast procedure.

Your best way out is to discuss this situation (candidly) with your VO. Send your CHC an email asap. Inform everything about his discourtesy to u & about his non-contact / non-cooperation. And take it from there.

Since he was under 22 when you applied, his age is locked in and he could still qualify as a dependent child, however, since he is now over that age, it will be easy to exclude him from the application based on him being of age and refusing to do the medicals. Do you have that in writing from him that he refuses? That would also help. You should do the medicals for the rest of the family but for this one son, write a letter stating that he is of age, being 23 and that he refuses contact with you and refuses to do the medicals. For all you know, he may qualify to apply for his own PR. He may even have done that already. You should include in the letter that you realize that this will prevent you from ever sponsoring him in the future.

Another thing that would for sure disqualify him from the family application is if he is married or living in a common law relationship but I suppose if you have not heard from him for 2 years, you would not know about that. If that were the case, then all you have to do is write a letter stating that your 23 year old son is married / in a common law relationship and therefore does not qualify as a dependent child any more and will not be a part of the family application any more.
 
I'm pretty much sure that since you applied "on his behalf" when he was underage...
and now he is independent, then you can discard him from the application.

But since this is not a typical case, I guess your best bit is to try to ask CIC?

I have not received any statement from him saying that he's not willing to join.. And yes I am think that he has either applied for a refugee status or a PR.
