Hello everyone,

I just got a very bad news this morning: my application for temporary resident visa (visit visa) has been rejected. I have applied online. My brother who is a Canadian citizen arrived in Canada as a Permanent Resident through FSW category 9 years ago, provided me the invitation letter. He works as a nurse in a hospital. Please see below part of the email that was sent to me:

Thank you for your interest in visiting Canada. After careful review of your temporary resident visa application and supporting documentation, I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR). I am refusing your application on the following grounds:
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your travel history.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the length of your proposed stay in Canada.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the purpose of your visit


In regards to no travel history, that is true since I haven't traveled out of the Philippines so far, but I don't think being in Canada for 3 weeks is a long time for me to be with my brother and my mother with our plan of travelling to Alberta, Toronto, and other tourist spots in Canada. Is spending time with my mother who is 69 years old not a good purpose of my visit? I don't intend to not return as all I want is to be with my mother and brother and will return after the said duration of the trip.

I am in the field of IT who has been in the industry for at least 10 years , with 4 kids and a spouse.

Please advise me what to do and when to reapply after the refusal.

I have applied for myself. I have provided bank statement from a bank which has been opened in 2012 and has an outstanding balance of 15k cad, employment certificate, paystubs, income tax return for 2018, proof of relationship with by brother - our birth certificates and his passport. He also provided his tax return for 2018 since he stated in the invitation letter that I will be staying at his place and will be responsible with my accommodation while I will be purchasing my plane tickets. I have also provided detailed itinerary for 3 weeks, though I didn't purchase plane tickets in advance since I think I have to wait for the result of my application before I can make fixed travel arrangements. I don't think that having no travel makes one person a high risk in not returning after a visit, nor travel history also guarantees that a person will be back to his home country after a visit. Thank you!
 
Not purchasing plane tickets didn't hurt your application at all.

The reasons for refusal in your case are a little confusing. I can understand travel history, but you have family you're leaving behind. The length of your proposed visit - 3 weeks - really shouldn't be a refusal reason.

You may wish to request GCMS notes to get some clarity.

Yes, I don't understand either and I have a genuine intent of just spending time with my mother and go back as you said I have my family back home and a good job that keep my ties in my home country. It is very frustrating. If the reason was the travel history as you said is understandable but the two other reasons I couldn't nor my brother comprehend. How do I request for GCMS notes and how soon? I really need clarification. Thank you for your advise.
 
You can have your brother request the visa officer's notes through the ATI program: https://atip-aiprp.apps.gc.ca/atip/welcome.do You request them from Immigration, Refugees, and Citizenship Canada. You need to fill out a consent form.

Or you can hire a company to do it for you - just search "order GCMS notes" in Google. Don't pay more than $30.
