I need your advice on following imp points;


1. I & my wife are PR holder and having 01 citizen daughter and 01 Pakistani citizen daughter.

2. we all want to go and live back in Canada ASAP if my 2nd daughter gets visa TRV/sonsorship in short time while sitting in Pakistan.

3. I applied TRV twice from home country but unfortunately refused.

4. We all are in Pakistan at this moment and now I need your advice, what to do?

5. My wife PR is going to expire in next month and my PR will be expire in Sep-2015. My wife is also pregnant and expected delivery in Dec-2013.

6. I had also sponsored my daughter in 2010 but i withdrawl the case because I was not in Canada and CIC has sent me letter for evidences.

7. Last time, I visited Canada in Yr: 2010.

Now, I want to know the options, I have to maintain canadian residency and can get citizenship. if i get my 2nd daughter's visa.

I would be obliged if you can guide in proper way so that I can proceed accordingly.
- should I go to canada immediately to maintain residency and then sponsor my 2nd daughter + expected child and what about my wife's PR? How can she go back ?

I suggest your wife and the elder daughter return to Canada as soon as possible. Once in Canada, your wife could sponsor the younger daughter for immigration and give birth. When the PR visa for the younger one comes out (hopefully it will be before your PR card expires), you could take her to Canada.
 
Thank you for your comments; But in that case. I have to be here in home country with 2nd daughter, right ?
But how much time it will take to get PR renewal of wife if she goes to canada for child birth? while she doesnt meet residency criteria.

saraza14, I have a Korean friend who had to return to Seoul for a wedding on June 6th of this year. He applied for renewal of his PR and received it within 3 weeks. Remember to send certified copies of all necessary documents including the current PR permit. Also include a letter indicating you need the renewal urgently and tell them the reason.
 
I am not an authority, but my understanding is: If you do not meet the required number of days in five years and apply for PR renewal you will alert the officials and may have more issues to deal with. You are better to get to Canada and put in the residency time before you reapply for PR. Read the official CIC rules and search forum. I wonder if you can get a TRP for your daughter on H & C grounds as she does not qualify for TRV (she cannot prove strong ties to her home country to ensure she would return before the end of her visa). Your wife should wait until she meet her residency obligation before she apply to get her new PR card. I have seen in this forum people had to wait from three weeks to 1.5 years to get their new cards (even if they request urgent renewal). Yes, you would need to stay with your 2nd daughter in the home country unless there is someone you trust to can take care of her in the home country and take her to Canada (when she get her PR visa).

I think that assumes that your friend met the residency requirements. In the case of the OP, it sounds like his wife doesn't meet the required number of days and as a result, her case will take longer (if approved at all).

Minimum residency obligations


You must meet the residency obligation to obtain a Permanent Resident Card.

If you have been a permanent resident for five (5) years or more

  • you must have been physically present in Canada for a minimum of 730 days within the past five (5) years.

If you have been a permanent resident for less than five (5) years

  • you must show that you will be able to meet the minimum of 730 days of physical presence in Canada within five (5) years of the date you became a permanent resident.

Of course, now that some posts have been deleted, this seems out of context, but as it's a good reminder, I'll leave it here.

1. So, It means that there is no way to get TRP/TRV of m daughter from home country while going to canada with parents so that she travel with us to settle in Canada, Right ?

2. My PR car is going to expire in Oct-2015 and i didnt stay 3 years in canada. only stayed 1 month. now only 02 years (730 days) left in my card expiry so Can I stay more in home country for next 3 months so that my wife will give child birth here and i will leave them all while leaving.

3. What will happened if my wife's PR card expire by the time when i sponsor my other kids from canada and Can she get TRV/TRAVEL DOCUMENT from home country to travel with kids while she didnt meet residency? Do I need to sponsor her again or not ?

Assuming this is your initial PR card, you still have time to maintain your residency obligation. Therefore, you can return to Canada asap, leaving behind your wife and 2nd child. Your 1st child who is Canadian citizen can either stay with the mother or return to Canada with you. When your 3rd is born in Pakistan, you can initiate the sponsor and immigration process to get your 2nd and 3rd child PR visa.

If your wife lost her PR, while you are in Canada, you can sponsor her to come to Canada as a new PR.

1. You mean that I have to go canada before 22-Oct-2013 as my card will be expired on 22-oct-2015 to meet residence obligation, right ?

2. My question is that if I stay more 3 months in home country and then i will continous stay in canada for next 730 days upto Dec-2015 then Will Immigration staff will ask any question/stop me on airport while entering in canada in Dec-2013 ??

Depends on the border officer you encountered at the airport, you may or you may not be stop while entering Canada on Dec 2013. I haven't yet seen any cases like that in this forum.

For now, try to apply the TRP for your daughter.
