Agreed. Correct me if I am wrong,but I feel this is unlikely. The reason being that if the guideline needs to changed from five year period prior to date of renewal application they could change it as what. The following are the options.
1. Could rule that all those with an expired PR card must renew immediately or or will never be done. This would bring out everybody in violation of RO. In my estimate this number would be too large.
2, Could rule that beginning from date on which the individual became a PR to the date of renewal application proof of residency 730+ days must be shown in all five year periods.
3. Could increase the RO requirement to 1095 or more days.
Options 1 & 2 would mean H&C grounds will have to be struck down as there could be many PR permitted inside Canada on discretion of CBSA officer or on H&C grounds
Option 3 is a major overhaul and may not happen as new rules are in place as early as Jan2015
