hi, im a british husband. my wife is a canadian PR holder and her application is in process for citizenship in canada. we live in the uk n in the mean time my baby was born in the uk (outside canada) in April-2010. she is also british born on my status. currently my wife n baby r in canada for attending her canadian citizenship test. in fact she appeared in the test n waiting for the result. so hopefully she will get her citizenship very soon.
my question is, is my baby born in the uk get canadian citizenship by birth on my wife's status as PR? or is there any other way baby can get canadian citizenship while they r in canada? and how long the processing time is?
v r planning to move to canada permanently in the future.
please reply soon!!
thank you.

As neither of you were citizens at the time of the child's birth, then the child would have to be sponsored to become a Permanent Resident. Once a Permanent resident, you could apply for citizenship on her behalf. She doesn't have to meet the 3 years residency requirement if under 18.

Thank you very much PMM.
but i need to what is the procedure and know how long it gonna take to get her PR while they r in canada. please..
there would b realy grateful.
thanx.

From your post, it would appear that you and your family don't have any intention of living in Canada at the present time. But your spouse or you would have remain in Canada and sponsor the child. It would take about 6 months.

Thanks PPM, its really appriciated. i was bit confuse coz according to the british law new born baby gets british citizen if one of the parent either hold british citizen or PR at the of birth.
once again thanx for your help.
may god bless you and help you for helping others.

Under Canadian law, a baby gets Canadian citizenship if it is born outside Canada to a Canadian citizen parent or if it's born in Canada regardless of the status of the parents. Babies born to PR's outside Canada have to be sponsored for PR.

Since you would also have to be sponsored for PR if you intend to move to Canada permanently, you can wait until a few months before you want to move and then your wife can start proceedings to sponsor you and the child for PR. As a Canadian citizen which she will be by then, she does not have to be residing in Canada to sponsor you for PR.

Thanx Leon, this is really greate news for me as my wife doesnt have to b there to sponsor me n baby. i think that would b much easier for us while being sponsored from here as v r already settled here.
its very kind of you Leon. may god bless you.

Does it any way help if we parents are PR and our Baby is born in Canada and is citizen, does same rule apply to us that even we live out side canada with a Canadain Citizen we can maintain our residency or this is not for parents.

It does not apply to parents. The baby is outside Canada accompanying the parents, not the other way around.

Yes must be otherwise every second parents would have been out (as I know people around me)
