Your post is super confusing. If one is married in a foreign country and doesn't declare that before landing, then it's a misrepresentation. There is a case of a male nurse who got deported because he lied during the process:

I agree you cant lie on your application since if they caught they will revoke your PR/Citizenship. There are two choices 1) Live with whatever he declared or Hire a lawyer to correct his mistake.
 
If you married in India and applied as a single you are not married legally in Canada yes you were married in India but it has nothing to do with Canada. Whatever you declare is your truth I know people who forget to declare their brothers now even their brothers cant get points for relationship.
This is simply not true!

Canadian marriage and civil union laws define what is considered as a valid marriage. They specify what culture appropriate rituals need to happen in case of a marriage officiated by a religious worker such as a priest and what kind of legal documents can be accepted as a proof of marriage. And those are not limited to geography.

Otherwise people will have to redo their marriage here after coming here.

Looks like this guy is a shady character. He got into a contract marriage with a PR to apply for sponsorship but once he got his own ita realized it's gonna be trouble to declare his marriage and applied as single and now wants to dig out of it. Too late buddy we are on to you.

Still could have just declared that and divorce her later on.

Life itself can be very very weird and shady. God knows what his personal situation is. Some people's life gets complicated like hell for no fault of their own. Let him work it out with someone who has seen enough complications with laws. Most of us have not seen enough situations to help him even if we want to.
