HI ALL,
I am a temporary foreign worker,was a plumber in my home country,which is India.went to a canadian post secondary institution and completed a 1 year certificate program in the same field(which is called a pre apprenticeship prog.) got a PGWP.worked with a canadian company for over a year.PGWP IS about to expire and my PR application under FEDERAL SKILLED TRADES CLASS got rejected.It passed the 1st stage though saying it was good for processing. someone said it wasnt my category in the 1st place but my lawyer(big lawyers in downtown toronto) said it was. It didnt need a CERTICATION,LMO..just a permanent job offer,past WORK experience,language testing,qualification from home country and completion of at least one year from a canadian post secondary institute.I HAVE IT ALL...!!!!!!.

Now can someone here please please please tell me which category I am good to apply in?? CEC??
OR ANY OTHER.

OH AND BY THE WAY MY LEGAL STATUS EXPIRES IN 5 DAYS
 
Hi Sanat, you don't state the reason for refusal, so I'll talk about the CEC Class. You would need one year of full-time work experience in Canada, but this excludes experience gained as a student. You say you have over one year of experience, but you completed a 1 year program, so would get a 1 year PGWP, which is only now about to expire, so it does not sound like you have 1 year of post-educational experience yet. Once you do, you would likely be eligible to apply under the CEC program (language benchmarks may higher under CEC).

You say your PGWP is about to expire, which is really unfortunate timing, given the holidays. If you could get your employer to submit an application for an LMO, you could then submit an application for a new work permit (online is fastest), and continue working, but only if this is accomplished BEFORE the work permit expires. (You need to submit proof that the LMO application has been submitted to apply for a new work permit without the LMO).

Because you are currently on a PGWP, your employer would be exempt from the advertising requirements (scroll down to the section "Advertising" on the HRSDC site):

Your employer can still apply for the LMO after your permit expires for up to 90 days, but if you don't apply for a new work permit before the old one expires, you cannot continue working, you would not be under implied status, you have to stop working until you receive a new work permit.
