Dear Sir,

i am very much thankful to you for your previous nice coopration.

I became Permanent Resident of Canada in May 2006 , but I couldn't
complete required (2 years) stay during 5-year time frame because of the
unavoidable circumstances.

My P.R Card got expired in June 2011. To Settle in Canada with my Family I applied for Travel
Document but Canada Immigration has refused my T.D application on 26
September 2012. i don't want to go for apeal.

My whole family (spouse, son , daughter in law , grandchildren ) are
living in Canada so I want to permanently settle in Canada now.

My spouse is Permanent Resident of Canada and living in Canada and
also has applied for Citizen of Canada on August 2012.


My wife is ready to sponsor me in Family class (spouse) category.

I would really appreciate if you can give me answers to my below
questions


(1) How can I renounce my existing (expired) P.R status?

Is there any form I need to submit to Canada Immigration?

(2) When can my wife file the sponsorship application in Canada?

1) Talk to the embassy about giving up your PR status. Tell them you need a form called IMM 5538B

2) She can file for sponsorship once you have lost your old PR.

Dear Sir,

Regarding my Previous Subject,Please help me in below questions

(1) My T.D refused , To go for Apeal i have 2 reasons for Humanity Ground
(A) My old Parents care with medical ground with medical certificates (B) Mentally Dependent Brother
(with Medical certificates) ,so to take care of 3 Persons
i could't fulfill 2years required stay in Canada
Is 2 Reasons are sufficient for to win in Apeal ?

(2) how much take the time in apeal procedere ?

(3) I could't live with my wife for last 3 years so imortant value of ' Time' What is batter......
Go for Apeal OR renounce/giving up P.R Status( My wife will sponser me for new P.R )

(4) if my Apeal will refuse, is it necessary to renounce/ giving up my Old P.R Status before my wife will sponsor me again ?
or automatically Old P.R status cancel / close

I would really appreciate if you can give me answers to my above
questions

1) It is possible that you will win an appeal with your reasons if you can prove what you say.

2) I do not know how long it takes for an appeal.

3) Which is faster depends on your country. You don't say where you live but that is very important. In some countries, you are looking at several months to get your new PR. In others, it might be a couple of years.

4) They should revoke your PR status if you lose the appeal but you might want to ask the embassy just in case. Your wife can not sponsor you for PR until you have lost your old PR.

If no appeal is filed within 60 days then one no longer remain PR based on TD refusal letter.

It takes about 1 and a half year to settle a residency obligation appeal.
