Hello,

I was wondering if you could help me with deciding if we need to hire a lawyer or what else we can do to strengthen our application for outland spousal sponsorship.

I am currently in the US on a work permit (STEM OPT) but also applied for asylum last April 2022. My spouse and I met last year, in June 2022, and got married in June 2023. We are from the same country, speak the same languages, have similar career paths, of the same religion, our parents knew each other and we were introduced through his sister. My spouse visited me in my country multiple times and our parents were present at our wedding. We also have a lot of evidence of traveling together (plane, train, Airbnb tickets, etc).

I am stressing because the total duration of our relationship (1-year dating, and less than 1-year marriage) is short. I am thinking about ways to successfully join my spouse because we want to start building our family. I am also stressing if our young age will be flagged by IRCC: 21F and 25M, even though it is normal in our culture to marry young.

Do you think we should hire an immigration lawyer? If not, how else can we strengthen our application to get it approved on the first try?

It's ultimately your choice if you hire a lawyer or not.

To me, the complicating fact about your application is not the 1 year of dating or less than 1 year of marriage but rather the fact that you have applied for asylum in the US. This could make it look like you are trying to find a path for staying in North America and your marriage is another way you are attempting to do this. However if you have strong relationship proof (which it sounds like you do), then it sounds like you should be OK. Ultimately up to you if you use a lawyer or not.

Make sure you're aware of what happens once you are approved for the PR and leave the US (likely with your asylum claim still unresolved). This may mean you are unable to re-enter the US for a period of time or without obtaining some sort of special visa.

What is your wife’s status in Canada and did she ever apply for asylum? When did you get your WP in the US? Assume this must have been before you claimed asylum? Are you working with a US immigration lawyer? Did you get married in your home country? If you got married outside of the US I am surprised you were able to return to the US after you applied for asylum. Did you check whether your WP remained valid once you claimed asylum. I am not familiar with the US system but was under the impression you had to wait 6 months before qualifying for a WP.
