Hi guys, I would be grateful for your valuable insights into the case given below.
I have enough CRS points to apply for PR. I have done a 1 year course in Canada and now waiting for work permit. I am in a dilemma here. I have been in a relationship for 2 years now. But we are not in a good place to get married right now. My boyfriend also has done a 1 year course with me. We both have only 1 year stay back period. Initially I thought of submitting the PR with me as a primary applicant since I have the necessary IELTS scores and then sponsor my boyfriend after getting married. But only recently we have discovered that spousal visa approval will take relatively longer period of time. Therefore we are thinking of submitting for PR together with me as a primary applicant and my bf as the joint applicant.
The confusion here is whether we should get married soon here in Canada or should we submit by common law relationship. We have been staying together for more than a year in Canada. If we decide to get register married soon in Canada, will the short term of our marriage be valid in front of CIC? Let’s say, if I get married on October 30 and submit Express entry file on November 5, will that be considered as a genuine relationship?

If you are already common-law, you are legally required to include him in your app. There is no choice.

Just checking that you have been living together for one continuous year. If this is the case you have to include him in your PR application as common law. Is a court marriage customary in your religion or culture? Would not suggest you get married quickly if you can prove that you were common law for over a year.
