We are currently waiting on approval or refusal for my husbands second extension to stay in Canada as visitor. In the event of a refusal do we have time to submit pr application without background check as I was told Vic request for it later? Basically do we have 30 days to reapply extension and show proof of pr application in process with receipts ( which we submitted with pending application anyway) and Aor of course. Sorry to ramble but I just don't want my husband to be deported after 30 days once the decision is made :( please advise what to do ? Thank you
 
Are you applying inland or outland?
 
You can submit the Inland application and an OWP application (together) before his status expires.

Unlike a visitor extension, that needs to be approved, sending the Inland application and OWP will automatically give him Implied Status, allowing him to legally remain in Canada during the entire process. He will also receive the OWP in ~ 3-4 months. Just make sure to include the full amount for the OWP ($255, NOT $155).
