Last month, September, we filed our Family Class application(s) for my wife and her son to become Permanent Residents.

They are both in Canada legally on Visitor Visas that expire at the end of December. I guess I will have other questions about what (if anything) they need to do to maintain their status while we wait out the processing time...but my question today relates to Study.

At the present time, my wife's son (aged 19) is attending a Community College, on a month-to-month basis, studying English as a Second Language. It is his hope that, after he makes the language grade, that he will be able to enroll as a 2-Year Business Diploma student. For this, he would need a Student Visa.

So, my question is...can he apply for a Student Visa from inside Canada while he is waiting for the Permanent Residence application process to conclude? Obviously, if he must apply for this kind of Visa from outside Canada...we would run the risk that the application would be denied and he would be left "out in the cold" so to speak, with his mother and I still here in Canada.

1. No, he would have to apply to outside office, one in the US is fine. You can do it by mail.

Just to be clear, are you saying we can mail his application (from within Canada) for a Student Visa, to a Canadian Immigration office in the United States...and then when the Visa is granted they will just mail his Passport back to us here in Canada?

That is, he does not have to physically leave Canada to apply...he just needs to send the application to an office outside of Canada?

No, if the study permit (LOI) is issued, then he returns to the border, goes to the US side, gets an administrative rejection, returns to the Canadian side and gets his study permit.

I am going to confess...I am feeling rather dense/confused here.

He is in Canada now, on a Visitor Visa, but has applied for a Permanent Residence Visa (as my wife's dependent).

So...and stop me where I go off the rails please...

1) We download the appropriate forms for him to Apply for a Student Visa
2) We properly fill them out, and then send them to __________ ?
3) This office issues the study permit (what does LOI stand for?), and sends it to ________? (How are we notified that it has been issued?)
4) So, he then travels to the U.S. border and goes across to the other side. They will send him back because he does not have a Visa to go to the U.S. (is this what you mean by an administrative rejection?).
5) He comes back to the Canadian side, and they let him back in (? even though his Visitor Visa is a single entry one ?).
6) He then gets his study permit from ______________ ?

I sincerely appreciate your advice on this, and I apologize for not understanding the process you are describing. If you can fill in some of the blanks on this for me, I would be most appreciative.

3. LOI , Letter of Introduction, this an approval so you can get the STudy Permit when you enter Canada., it is sent to you if the application is approved.
4. Yes.
5. Yes, because he was not admitted to another country.
6. From the Border office, i.e. If you lived in Vancouver, you go to the Douglas/Blaine. You get "rejected" at the US office, then you return back up the road to the Canadian Customs office, and tell them you are here for a study permit. You will have the rejection letter in Hand.
