Hi All,

I have applied for a college admission for Jan 23 intake. Currently I am in Canada on a SOWP. Due to the constraint in the time and holidays for IRCC. Can I do flag poling of Study Permit at the US/Canada Border. Some people have recommended this option. I am on SOWP currently and staying with my Spouse and Kid. Will the border officer issue study permit for me and simultaneously issue a work permit for my spouse based on my study permit or I need to apply through IRCC and wait for the approval. Please advise.

Apparently, if you apply for a SP spouse won't be elegible for a SOWP because she is currently a SP holder as the principal foreign national. Here is a thread with a question similar to your's: InLand study permit application | Canada Immigration Forum (canadavisa.com)

If meet the below points, you can flagpole.

Who may flagpole to apply for a study permit?
The following people may apply for a study permit at a Canadian port of entry:

  • A US citizen,
  • A PR of the United States, or rather a Green Card holder,
  • A person that the US has lawfully admitted for permanent residence,
  • A resident of St. Pierre and Miquelon, or
  • A resident of Green Land.
If you are on a SOWP based on your spouse having a study permit or closed work permit then your spouse is not eligible for a SOWP. Your spouse is the principal foreign applicant and IRCC changed rules to allow principal applicants to then switch to a SOWP.

Your spouse doesn't qualify for a SOWP due to IRCC's new principal foreign national rule.
