Hey,

I'm a single mother and currently pursuing a master's degree thesis based in Canada. I have twice requested a study permit for my 10 years old child. But the IRCC keeps rejecting my child's study permit.
I have attached proper school admission letter, home contract, demonstrating financial stability, and Legal divorce and child custody paper.
IRCC gave the reason that Child has strong ties in Canda but not outside of Canada.
I was told by my friend that I had made a mistake in applying for a study permit for a single parent child and that I ought to have applied for a tourist visa. I would be really appreciative if someone could help me with this.

So you are in Canada now? Did you apply for your child when you applied for your study permit?With two refusals you face an uphill challenge. Were the reasons the same for the first refusal? When do you finish your studies and when does your permit expire?

You were correct to apply for a study permit as your child would attend school. A study permit is not guaranteed for your child. What are your child’s ties to home country if you are in Canada? If you are in Canada, then IRCC knows that you will return once you have completed your studies. Your study permit may have been approved because your tie to return is your child.

So you can try again with strong documentation that you will return after your studies. Assume you have approval from spouse for child to leave the country. Show this as strong ties that other parent approves the move and that there is an expectation you will return with child after your studies. Also include child care as assume child would need child care if 10 years old. Show documentation that you can afford the care and child has a spot in care before and after school as well as when you are at school and working.

Yes I am in Canada Since Sep 2022. I got my visa in May 2022 then when I discussed my decision with my child. She started arguing and complaining so I decided to apply for her study permit as well. And when I landed Canada I got her first refusal. They mentioned the 3 reasons. 1)that she will not return, 2)financial situation, 3) current situation is not habitual. Then I focused more on my studies , got good grades and full time employment as well. So I decided to apply for her again Feb 2023 , as she is getting sick again and again due to this separation. And got second refusal with only one reason that Strong ties available in Canada not outside of Canada. I am mature student and I was in UAE since 2007. I am looking some direction. Can I apply her visit visa Or what i have to do. I have legal divorce and child full custody paper.
My study permit will expire next year, 30-Aug-2024. but my master program is 2.5 years, we can extend our study permit by 6 months if required. I have full child custody , Do still I need her Father approval? As her father left her when she was 2 years old and he never came back.

Where is your child now? Assume your child has a passport without father’s approval so travel should not be an issue.

You were correct to apply for a study permit if the intent is for your child to stay and go to school. What are you going to change in your TRV to show ties to return? Still need to address that reason for refusal. The issue is your child has 2 study permit refusals and now applying for a TRV. A TRV is to visit, not live and go to school. IRCC will see the past refusals and wonder why you are applying for a TRV now.

She is in India with my parents. Yes she has a valid passport , where her father approval is not required. As I have full custody.
Is it okay ,if i transfer my property on her name as a birthday gift and Get a letter from school , Where school demonstrate that on her return, she will start her study back in same school . Do you think these 2 letters can help her case? Can I apply third time with these letters? Will this be a help for her study permit. Please advise.
Or I have to wait and apply for her third time , The time when I will apply for my workpermit

Why would a 10 year old need property? This will raise red flags if you transfer the property and then apply for any permit. IRCC will know why you are doing it. She is 10 so property is not a tie to return.

So you are getting a letter from her school in India including registration and tuition paid to show ties to return? That may work for a TRV. But if you are applying ofr a study permit, no. Why apply for a study permit in Canada showing ties to go back to India to study. Her ties are you and you are in Canada.
 
How much liquid savings have you shown? How much savings will you have if you deduct your tuition for your full degree. It sounds as though you may not have lived with your daughter in the UAE as well. Was that the case? Would suggest ordering GCMS notes to get more detailed information about the refusal.
