Hi all,

My study permit was rejected on Monday on the ground that I "do not hold a valid US status." I am on the grace period after my OPT as a student in the US and that grace period is considered a valid status under US law. Any suggestions on how or if I should move forward?

And for those interested my timeline is below:

Submitted online application: June 30
Biometrics completed: July 16
Decision: July 27
 
Apply from your home country. When they ask for proof of your US status they generally want to see something longer-term than the grace period for you to depart.

Unfortunately I can't apply from my home country because it's on lockdown due to Covid. I will have to apply for a change of status here while I wait for the lockdown to be lifted. I'm just not sure that a pending application to change status would make a difference

Did u apply during grace period or before grace period?

I doubt it would. There is no rule against applying while your home country is on lockdown.

IRCC wants to see that you are in the possession of a valid visa. They generally don't consider grace periods. Yes - this gives you valid status from a U.S. perspective. Canada wants to see that you are in possession of a valid visa.

I think you have two options: (1) Return to your home country and apply from there; (2) Wait until you have a valid U.S. visa again and reapply.

How about someone apply in May and grace period starts in August? In general, if you apply in May, you will get result in June or July. However, because of COVID-19, the processing time becomes longer. It is under control

What is ur expiration date on US document that u submitted to IRCC?

I am also applying from US. May I ask if you have submitted the following?
- Letter of explanation to explain your status in the US at the moment
- Your I20 to validate your student status
- Your US visa foil scan to prove that you have had a US visa even if expired
- Your EAD card
- Information from USCIS regarding 60 days grace period from EAD expiration date

It sucks to get rejected now and during this pandemic. I think the best path forward is to go back to your home country and apply from there. I also will depart the US soon.
