Hi Folks,

Need Urgent Help!!!!

Study Permit Extension ( + SOWP extension for husband) Got Refused!

*I have started studies in Jan 2022 and attended 3 semesters, ( passed 2 semesters) then due to some personal reasons stopped studies

*Study Permit Expiry Date: 30 Sep 2023

*I have applied for study permit extension on Sep 30,2023 (along with SOWP extension for my husband)

*Got a letter from my college after paying fees which stated that I am enrolled in 2 year program my program start date and finish date is April 2025

* Provided other supporting docs as required

* Didn't hear anything for 4 months from IRCC, they then sent an email on feb 12,2024 that they need all my transcripts of Canadian studies to be provided till feb 19,2024. Unfortunately again I was sick and missed that email and was unable to provide transcripts of completed semesters


RESULTS:
My application got refused on the very next day Feb 20, 2024 and the reason I got was that I didnt provided requested docs. Refusal Letter stated that my temporary resident status expired on 20 Feb 2024


Next Steps:

1) Am I eligible to apply for study permit extension and status restoration !
because if I calculate 90 days after my study permit expire it is Dec 31,2023 but The letter states that my temporary status expired on feb 20,2024 and I can apply for restoration within 90 days, Please advise

2) Based on my scenario what are the chances of approval as per your experience ( I have stopped working and studying already and will resume once status got approved)


Any help will be highly appreciated

1. Within 90days from original date of lost status+maintaned status duration, you can apply for restoration
2. I cant give you chances, but there are three red flags the way you handled this situation.
-You passed two semesters out of three. this does not demonstrate progression toward completing your studies
-You applied to extend your SP and SOWP on the last day your status expires. Though you can technically do that, but why delay until last day?
-It appears you were still working after stopped studying until when you got decision in Feb 20, 2024. Thats another problem if they decides to request information from your SIN.. If you stop studying, you are not eligible to work

1) Yes, you can apply for restoration.
2) No one here can tell you the chances based on the information you have provided. A number of things are not clear in your timeline including when you stopped your studies exactly and if you have resumed them, as well as whether you have continued working.
