Student with Common-Law Partner needs visa form advice

Hi,

I am a student who will be heading to Canada for a study exchange in January, I have just had my confirmations so can now apply for visa's etc. My partner would like to come with me on an OWP.

I have completed the questionnaire on the website and filled in most of the forms it asks for, electronically. I just have a few enquiries about some of the papers and I cant seem to get hold of a human being on ANY number or email listed ANYWHERE for CIC.

1) Declaration of Common Law - if this is an online application do I need to get the form notarized and how do I do this in Scotland?
2) Letter of Explanation - What is that for?!
3) Letter for Purpose of Travel (for my partner only) - What does he need to do for this, the purpose of him travelling is to see and experience canada with me and possibly get some part time work while he's there?
4) What kind of additional documentation do we need to provide?
5) We MUST travel on 2nd January for me to start my course, can the application be in progress still while we move? Or can he change the application type to say an individual application for and OWP via 'International Experience Canada' when they come available?

and finally..... if we make a mistake anywhere on the forms (likely considering we cant ask a human at the CIC about anything) then do they cancel it and we would have to reapply? I wouldnt want to do this as we have such a quick turn around.

2) Just a short essay on how the course you're doing in Canada relates to your previous study/work experience and your future career plans. Optional, but recommended (I think). Here you can also convince the visa officer that you will leave Canada after your studies.
3) I don't know, but what you wrote sounds reasonable, just make it in the form of a letter
4) It's all in the checklist
5) The application can't be in process when you travel. At least if you want to get your study permit issued at the port of entry. Since you're British, you're visa exempt and the border officials would probably allow you in as visitors, but you can't legally attend school without a study permit. To get the study permit, you need the Letter of Introduction issued by CIC when they approve your application.

To make it more awkward i'm actually an exchange student only going for a semester, so technically I dont need a permit to study as im British HOWEVER I have been advised that in order for my partner to get an OWP, I need to have a Study Permit.

I know I will probably be ok but Im worried about his part of it. Are they likely to let him on a visitors visa as he is British, even though a OWP may still be in progress?

Has anyone had an issue with this or can offer advice?

Does anyone know if an application can be in progress while we cross the border? As British Citizens we are entitled to a 6 month stay anyway but if he crosses with the ultimate intention to work and the visa isnt yet complete, will he be turned away? He wont work until its sorted but how do we prove that to the Immigration team?

Sounds Good to me..as, he already has a visa to enter

if asked, what you will primarily need to prove to the Immigration team is that you have sufficient funds for your stay in the case either of you are not working...

rest of it should go fine, if you say the case to them that he is entering only to stay with you and might work if he gets an OWP

Your partner can apply for OPW, along with your application or you can apply online for your spouse. I dont know exact rules for scotish citizens, in general as per the CIC spouse visa policy, your spouse should fall under occupational skill list O,A and B to get the OPW.

1) Declaration of Common Law - Either marriage certificate or authority letter declaring your relationship.
2) Letter of Explanation - Statement of purpose, you need to request immigration to grant visa for your spouse.
3) Letter for Purpose of Travel (for my partner only) - Spouse requesting CIC for visa, need to explain.
4) What kind of additional documentation do we need to provide? - TRV 1 need to be filled and uploaded.

please follow the check list given in the online form, and also educational document with $4000 deposit bank statement and your passport details. all documents must be scanned in a single file and upload. your spouse will get the medical request in few days, once medicals are done CIC will request for passport deposit for visa.
