Hi, I was wondering if anyone could help me.

Im studying Forensics with a year abroad study at University and I want to study in Canada but by the time I apply for a visa I will have a 3 year old criminal conviction as well as sex offence registry.

Does this completely rule out my chances or will I get a chance of consideration and to explain the offences as the actual crime would be over 5 years old. I really want to study in Canada and im worried I won't be allowed in.

Before you can apply for the study permit, you will need to apply for rehabiliation and wait for the rehab application to be approved. You cannot apply for the rehab application until five years have passed from the time you completed any sentence / paid any fine related to the crime. So if only three years have passed, this won't be enough. You'll need to wait 5 years before you can submit the rehabilitation application.

The time of the actual crime isn't what's relevant. It's when you completed any sentence / paid any fee / completed any probation associated with that crime.

Okay thank you! So essentially, I've applied for a course and won't actually be allowed to study in Canada at all? Theres no way I can have the ability to talk to a member of immigration and pray I get acceptance for a single academic year? Im trying to move on with my life and its heartbreaking to see a stupid single mistake as potentially ruined my dreams.

So I wouldn't even get the chance to explain that I was a teenager at the time of the crime and have the chance to explain myself with it all?
it depends on the cbsa officer you meet on the day at the port of entry.

I missed your second post. How old were you when this happened? That might make a difference.

I had just turned 19 years old

In that case you are inadmissible to Canada based on the information you've provided. Being inadmissible means you cannot enter the country due to your conviction.

As said in my original post, you'll need to wait until 5 years have passed since you completed the sentence / fee / probation associated with your conviction and then apply for rehabiliation. Once rehabiltiation is approved, you'll be able to apply for a study permit.

I just found this were you can apply for special permission (at the bottom of the page) along with a temporary residency permit and study permit; so I presume this will be my only option in attempt

Sure - you can do that but you should assume the chances of approval will be very low. IRCC normally only approves exceptions when there is a very strong need for someone to be in Canada which overrides the inadmissibility (e.g. visiting a terminally ill relative, coming to see a minor child who is Canadian and living in Canada). Wanting to study in Canada won't be viewed as a strong reason for overriding inadmissibility. But again, you can certainly try.

Okay, thank you all for replying and advising me! Again at the moment, im just looking into it but when the time comes, at least I have the expectancy rate of getting in there already as well as the documents needed if I were to try! I appreciate all you help! :)

Study forensics with a criminal background? That's like studying animal science with a conviction in animal torture. Or is this your display of repentance and path to restitution? :)
