My bf was here on a work visa ..his work visa has since expired... His 90 days are done .. But I now want to sponcer him we have been together for almost a year ..what are the requirements needed to sponcer him? Financially, legal ect. Thanks

It's too late to restore his status from within Canada - it's too bad he let his status expire.

You can apply to sponsor him as your spouse (provided you are married) or common law partner (provided you have lived together for at least one full year and can prove it) using the inland/within Canada method. Note that he won't qualify for the open work permit pilot. This means he will have to wait until the application has first stage approval before he can apply for an open work permit (this will take at least 16 months from the time his application is submitted).

You could also sponsor him using the outland/outside of Canada method. This may be shorter or longer than inland depending on where he's from. There is no open work permit available with the outland mthod.

Note it's possible the processing time of your application could be longer if CIC has concerns your relationship is genuine due to his overstay.

Detailed application information here: http://www.cic.gc.ca/english/immigrate/sponsor/index.asp

Until you have either lived together for one full year, or get married...you can't even start the sponsorship process.

The fact that you do not qualify [yet] and the fact that he's already out of status, really makes it difficult for the both of you. Yes, he can technically apply for sponsorship without legal status, but it will be a lonnnng process (over 2 years if submitting an Inland application) and he would not be eligible for a work permit for ~ 17 months after the application was received by CIC. It would be another couple of months after that before he actually received the Open Work Permit. There is also NO guarantee that he would be allowed to remain in Canada during the process. Most are, but not all.

Another option would be for him to leave Canada, as soon as you have met the requirement to sponsor, and submit an Outland application.
